McIntosh [McKentosh], Angus (Administrators) of Richard Donovan [Donavin] Estate vs. William Henry Harrison and Jesse Thomas (Administrators) of John Hamtramck estate 1807

Description: This file contained the suit Angus McIntosh as administrator of Richard Donovans estate, brought against the administrators of the estate of Jean Francis Hamtramck in the Court of Common Pleas of Knox County in 1807. The administrators of Jean Hamtramcks estate were William Henry Harrison and Jesse Thomas in the name of his wife, Rebecca Hamtramck Thomas, the widow of Jean Hamtramck. The complaint filed by McIntosh stated that on August 3, 1803; Jean Hamtramck was indebted to Richard Donovan of Detroit for $82.00 in goods, wares,etc at Detroit. The complaint stated that Harrison and Rebecca Hamtramck had not paid the debt and he asked $150 in damages. One document, the court record of the Territory of Michigan the District of Huron Detroit; Saturday, 20th day of Term in 1807 at the house of Elyah Rusch, Esq. of Detroit stated that Henry Hurst proposed to be examined before Justices of the Peace, Robert Abbott and Peter Audrain. Also present were: Angus McIntosh, Eluah Rush, attorney for the Defendants, at the request of Soloman Libbey their agent (who was absent). Henry Hurst swore that the account of Richard Donovan, deceased, against the note of the late Col. Francis Hamtramck, May 5, 1802 was accurate except for two spelling books, ladies dresses, and a quarter of mutton. He further testified regarding Rebecca Hamtramck account. A summons was issued for William Henry Harrison, Jesse and Rebecca Thomas by Robert Buntin, Clerk to appear in court to answer to Angus McIntoshs plea of trespass and damages of $150, during the March Term of the Court of Common Pleas. It was executed by Parmenas Beckes, Sheriff with fees of $.46 1/2. Robert Buntin, Clerk, signed a court order for two Justices of the Peace in Wayne County in the Michigan Territory to examine witnesses on behalf of Angus McIntosh the administrator of the Richard Donovan estate in the case pending on the estate of Jean F. Hamtramck with William Henry Harrison, Jesse and Rebecca Thomas as administrators. A ledger of the account of Colonel John Hamtramck to the estate of Richard Donovan was included in the file. It dated items purchased from 1802-1805 and listed items such as: gun powder, and shot, Hyson tea, 4 yards of white cotton, 4 yards of yellow binding, one piece of deaf(delft ?) Japo, white thread, mending a ring in Montreal, owners of the schooner Thames for weight account, delivery of wood, etc. Robert Abbott and Peter Audrain signed the account ledger. Included with the ledger was a statement written by Stanley Griswold, Secretary of the Territory of Michigan, verifying that the Abbott and Audrian signatures were valid. A jury, with Robert Evans as foreman, found for the Plaintiff for $141.52 Court cost were $23.01.
