Hague, William administrator of Jesse Mounts estate vs. Elihu Stout 1809

Description: The file contains the documents related to the suit the administrator of the Jesse Mountss estate, William Hague, brought against Elihu Stout for failure to pay on a Promissory Note for the mortgage of a property. On May 25, 1807, Elihu Stout signed an indenture (contract) with Jesse Mounts to buy property for $100.00. It was to be paid off by May 25, 1808. The propertys description was: The lot of parcel of ground with house and other dwellings situated on St. Louis or Front Street in Vincennes containing twenty-five toise (1 toise = 6.39436 feet) square. Bounded on the Northwest by Front Street on one side, on the Southwest by a lot of John Rice Jones, formerly belonging to Paul Gamelin, on the other side on the Northeast by a lot now belonging to the heirs of Major Ferguson, and in the rear or Southeast by the house and lot of Hyacinthe Lasselle, late belonging to Pierre Bono and formerly Jean Bpt. Calloutre. The indenture was signed Stout and witnessed by William Hague and Lewis Landers. A Promissory Note was signed by Elihu Stout for $100.00 to Jesse Mounts to be paid by May 25, 1808 with 12% interest. It was also witnessed by Hague and Landers. In Mach 1809, a Summons was issued for Elihu Stout to appear in court to answer to William Hague as to why the property should not be sold to paid of the debt. The Summons was issued by R [Robert] Buntin, Clerk, CPKC. According to the Minute Book of the Knox County Court of Common Pleas, 1807-1810 page 169; During the March Term 1809; the Plaintiff came by his attorney and the Defendant came not. It was ordered that a Judgment be entered for the sum of $100.00, with interest from the 25th of March 1807 and until the debt was paid together with court costs and charges. The property was to be sold to pay the Judgment.
