Harbin, John vs. Jacob Teverbaugh

Description: The file contains the documents related to the plea of trespass that John Harbin brought against Jacob Tevebaugh in the Knox County Court of Common Pleas 1808-1809. A Summons was issued for Jacob Tevebaugh to appear on the last Monday of November 1808. He was to answer to John Harbin in a pleas of trespass and damages of $300. The Summons was issued by R [Robert] Buntin, Clerk CPKC. On the verso side, tax paid and executed by P [Parmenas] Beckes, Sheriff with $1.31 court costs added. During the November Term 1808, Gen W. Johnston, the attorney for John Harbin, filed a complaint against Jacob Tevebaugh for failure to pay Harbin for goods received-- two steers. Payment was to be in fifty acres of land to adjoin Joshua Harbins on the upper side of the Prairie. The debt had not been paid the land had not be conveyed. On the verso side of the complaint, General W. Johnston was put in as the attorney for Harbin in this suit. Tevebaugh by his attorney, John Johnson, filed a plea of non assumpsit (he did not undertake or promise as alleged), and placed himself on the mercy of the country, the Plaintiff also placed himself on the country. Two Subpoenas were issued for George Tevebaugh, Abraham Tevebaugh, and William Robins to testify on behalf of Jacob Tevebaugh. They were to testify during the March and July Terms of 1809. The Subpoenas were issued by R [Robert] Buntin, Clerk CPKC. Deputy Sheriff, John McCandless reported not being able to find Abraham Tevebaugh and William Robins either time. August 1, 1809 an Arbitrators Report was written . It recommended that the Defendant pay to the Plaintiff, Harbin, the sum of $150.000 and costs of the suit and shall be in full for their contract about the land which appeared to have been the subject of their dispute. The report was signed by Peter Jones , E. McNamee, and Andrew Purcell. According to the Minute Book of the Knox County Court of Common Pleas, pages 177 and 205, the cause was continued during the March Term for want of a a material witness. In the July Term, the court ordered the following of the Arbitration Report.
