The file contained the documents related to the suit Thomas Jones, Sr. brought against the estate of Francois Racines estate during the March Term 1809. The complaint, filed by the Plaintiffs attorney, Gen. W. Johnston, stated that on October 4, 1799,Racine wrote a Promissory Note to Thomas Jones, Sr for value received. He stated that Racine had not repaid the debt during his life time nor had the administrator of the estate, Thomas Jones, Jr. He was asking for $500.00. On the back of the Complaint, Gen. W. Johnston was put in as the attorney for this suit. In response to the Complaint, Thomas Jones, Jr. could not deny the debt, but stated that he had executed the estate and he had no possessions or property of the deceased. He stated the suit should not have been filed. The Plaintiffs attorney asked for Judgment. A third document included the account of Racine with Jones, Sr., the Promissory Note (in French) and the receipt of payments on the note. The account ledger October 1799 listed the items in livers and sols: 1 pot 26 livers ; 1 small pot 16 L ; 6 sickles @ 3/ 18 L; 6 mens hats @ 22/ 32 L; 1 milk bucket 8 L; 10 black silk handkerchiefs @ 5/ 50 L; 1/2 Thread 6 L; 3 shalls (?) @ 10/ 30 L; 4 bunches beads @ 2 8 L; 1 roll tape 30 L; 12 yds velvet @ 5 62 L; 12 yds coating @ 10/ 120 L; 15 yds calico @ 3 / 45 L; 2 milk buckets @ 8/ 16 L; 1 muslin shawl 12 L; 1 silk handkerchief 6 L; 16 1/2 powder @ 4/10 74 L 5 sol; 20 skeins thread 2 L; cash 8 L; 68 gallons whiskey @ 5 340 L total 1012 L 15 sols. On the verso of the account sheet is the Promissory Note signed with the mark of Francois Racine. Also on the verso is the documentation of payments on the note. Received part payment, $40.00 in cash; paid to me to Jos Michel seven dollars four days work four dollars, six loads one dollar, to the hire of a mare to Cape Girardeau six; also a cow valued at twelve dollars. Vincennes 17th June 1808. According to the Minute Book of the Knox County Court of Common Pleas, 1807-1810 p. 169; Thomas Jones, Jr appeared in person and defended the wrong. He could not deny the debt that Racine had incurred, but stated there were no assets left in the estate. The court ordered that if any assets of the estate become available, they should be used to pay off the debt and any cost or charges the Plaintiff incurred during this suit. |
