Jones, Thomas vs. Alexander Chambers

Description: The file contains twelve documents related to the suit Thomas Jones, filed against Alexander Chambers for a failure to pay off his account with Thomas Jones. Items listed with cost, included some of the following: muslin, blue shawl, pepper, tea, calico, camphire, shovel, brimstone, pen knife, spangled shoes, silk, gloves, dimety, cambrick muslin, velveteen coard, etc. Noted was the amount due $113.41 figuring in Interest $126.31 1/2. On August 16, 1809 by his mark Alexandra Chambers promised to pay Thomas Jones eighty-five dollars in ten days for value received. The note was witnessed by Thomas Jones, Jur. and Robert Buntin, Jr. On February 10, 1810 a receipt was written to Alexander Chambers for the sum of fifty dollars credited in the book on his account by Thomas Jones, Sen. Thos. Jones, Jr. One receipt noted received of Alexander Chambers in part pay of his state. thirty one dollars, April 9, 1810. Signed Jones. Jones, Jr. A third receipt Vincennes September 3, 1810 received of Alexander Chambers by hand of John Small twenty-two dollars and fifty cent on account. The fourth receipt , received, Vincennes November 23, 1810 of Alexander Chambers by hand of Joseph Chambers seventeen dollars which I have credited in my books. Thos. Jones, Sen; Thomas Jones, Jr. A summons was issued by Robert Buntin, Clerk CCKC, on the 14th day of January 1815; for the sheriff to take Alexander Chambers so he would appear before the judges of the Knox County Circuit Court on the first Monday of March next to answer unto Thomas Jones that he render unto him $85.00 that he owes to damages of $100.00. On the verso, This writ is brought on a note under seal therefore bail is requires for $85.00 G.(General)W. (Washington ) Johnston, P.Q. The summons was executed by James Jordan, D. Sheriff . Noted for service and return $.059; miles 21, $1.26 Special bail $0.75; Total $2.60. In a memorandum returnable March Term 1815; on the 12th day of February 1815 John Chambers appeared before B. (Benjamin)V. Beckes, sheriff. that Alexander Chambers shall appear in Circuit Court the first Monday in March and if he does not he will render his body to prison or John Chambers will do it for him. The complaint was filed for the March Term in the Circuit Court by General Johnston, P.Q . It stated that Thomas Jones complained of Alexander Chambers that he render unto him $85.00. That on the 16th day of August 1809 in Vincennes he signed a promissory note promising to repay $85.00 within 10 days. He had refused to prepay the note, and the plaintiff asked for damages of $100.00. On the verso of the complaint, We of the jury do find for the plaintiff the debt in the decon. mentioned to be discharged by the sum of $63.00. Rich Posey, foreman. In a rebuttal to the complaint by Thomas Jones; Alexander Chambers by John Johnson defended the wrong and injury and stated that Thomas Jones ought not to have brought the action against him as he had fully paid and satisfied the debt. signed J. Johnson atty. Also noted and Thomas Jones replied he had not repaid the debt and asked for inquiry by the country. Signed G.W. Johnston. A subpoena was issued for John Small to appear in Circuit Court on Thursday next to give evidence on behalf of Alexander Chambers at the suit of Thomas Jones. This writ was issued by R. Buntin, Clerk, CCKC on the 2nd day of October 1815. It was executed by James Jordan, D.Sheriff with court cost fees of $0.64 12/. John Small did submit a deposition regarding the payment of twenty-two dollars. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 192 and 201 during the October Term 1815; a deposition was ordered for John Small a sick witness. Later, the plaintiff by his attorney, G.W. Johnston and the defendant appeared by his attorney. The jury consisted of Richard Posey, Amos Adams, James Timms, John Weaver, Sam Carruthers, Thomas Owens, Thomas Holder, Charles Archer, Anthony Sanders, Peter Frederick, Walter Neal and George Bogart. They found for the plaintiff, the debt to be discharged by payment of $63.22.
