Ensmener [Ensminger] Emanuel [Emenual] vs. James Grimer 1808

Description: The file contains the documents related to the suit Emanuel Ensmener brought against James Grimer for a failure to pay a debt of $273.00. The first document was a Promissory Note written to James Grimes of $273.00 for value received. It was to be paid in 10 days and signed by George and John Robinson. George Logan was the witness. On the back of the note I assign the within note to Adrian Davenport and Emanuel Emsminger for value received of items. August 8, 1807. James Graham. Also written on the back We do protest the within note as it has already paid to James Grimes. Signed John and George Robinson. On August 27, 1807; a writ of Attachment was issued by Israel Gready, J.P. He stated that Emanuel Ensmener stated James Grimes was indebted to Emanuel Ensmener for the sum of $273.00 and Grimes had either absconded or was going to abscond from the area. The writ was executed by John Foraster, Constable. On the back of the writ, he wrote Executed on one brown mare the property of James Grimes which property is at this time in my possession. Israel McGready at Shawney Town certified that John Foraster was a legal constable of Knox County. Emanuel Ensmener, Adrian Davenport, and William Cheek posted $470.00 bond on August 27, 1807. The condition was that Emanuel Emsmener had obtained an attachment before Israel McGready, J.P. Emsmener and Davenport signed their names, Cheek made a markfor his signature. An order was issued to sell the horse taken as property of James Grimes. The money was to stay in the hands of the sheriff until the case was decided. The order was written by R [Robert] Buntin, Clerk CPKC . On the back of this order, Isaac White is empowered by P.[Parmentas] Beckes, Sheriff to be special deputy. December 29, 1807. Isaac White sold the horse for $29.00. Beckes noted that he had the sum in his hands. December 27, 1808 an execution of the attachment order against Grimes for $273.00 and $14.30 (court costs) was written by R [Robert] Buntin, Clerk CPKC . According to the Minute Book of the Knox County Court of Common Pleas, pgs. 48, 83, 160; During the November Term 1808, The Plaintiff appeared represented by Gen. W. Johnston, the Defendant did not appear. An order was issued that the Plaintiff recover $273.00 and interest after payment of the horse. He would received costs and other charges from the case from the Defendant.
