Marney [Marny] Jonathan vs. Henry J. Mills (admin of William Mills estate) 1808

Description: The file contains the documents related to the suit Jonathan Marney brought against Henry J. Mills for a plea of Trespass for the failure of William Mills to turn over to Marney 100 acres of Military property and a cow and calf. In a Complaint filed by Marneys attorney, B[Benjamin] Park, it was stated that Henry J. Mills, administrator of the William Mills estate, on October 25, 1806, William Mills promised to convey to Marney one military sit of 100 acres worth $300. The site was on the south side of the White River. Marney was to choose one tract out of eleven tracts. He also promised to deliver to Marney one cow and one calf worth $20.00. The land, cow and calf were in consideration for a mare worth $320.00 that Marney delivered to Mills. The land, cow and calf were never delivered by William Mills nor his administrator. The document pledged to prosecute. The second document was the response of the Defendant, Henry Mills by his attorney Gen. W. Johnston. It stated that the Plaintiff was wrong in bringing the suit that William Mills did not assume in manner and form as set forth in the complaint. In addition, Henry Mills stated that he has administered full all the good and property of his fathers estate. The third document was the responded of the Plaintiff, who put himself on the mercy of the country. A Summons was issued for Henry Mills, administrator of William Mills estate for the fifth day of the Court of Common Pleas to answer to Marney on a plea of trespass and damages of $400.00. The Summons was written by R{Robert] Buntin, Clerk CPKC. The Summons was executed by Ben[Benjamin] Price in the presence of William Wells and Robert Crow. The tax was paid and $1.46 1/2 fees were attached. Four Subpoenas were issued for John Hogue and Abraham Fry Snapp for the November 1807 Term, March, July and November Terms of 1808. They were to testify on the behalf of Jonathan Marney in his plea of Trespass against Henry Mills. All of the Subpoenas were written by R[Robert] Buntin, Clerk CPKC. A Subpoena was issued for James Crow for the July Term 1808, to appear on the the behalf of Marney. the Subpoena was written by R [Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, D. Sheriff with fees of $1.36. A Subpoena was issued for Thomas Burns, William Wells, Isaac Montgomery and Cain Fields to appear at the July Term 1808 on behalf of Henry Mills. the Subpoena was written by R [Robert] Buntin, Clerk, CPKC and executed by James Crow , D. Sheriff. $3.09 fees were attached. Daniel Dollahan, John Youngman, Thomas Coulter also received Subpoenas to appear at the July Term 1808. They were to testify on behalf of Jonathan Marney. The Subpoena was written by Clerk R[Robert] Buntin CPKC. The Subpoena was executed by Samuel Hayes, D. Sheriff with $2.40 1/2 fees added. According to the Minute Book of the Knox County Court of Common Pleas, pgs 86,109, 129, and 151; the suit was continued during the November 1807, March, July Terms. At the November Term 1808, the parties appeared by their attorneys, the cause came to the jury. The jury consisted of: Thomas Neely, Peter Ruby, William Miner, Ephraim Gilmore, James Thrailhill, Solomon Tevebaugh, Jacob Miner, Samuel McClure, Samuel Moore, Robert Gilmore,Jr.; William Gamble and John McKee. The jury found for the Plaintiff $100.00 and costs and expenses. The jury also reported that the Defendant had fully administered the property with came into his hands. The court costs were $38.03 1/2.
