Emmison[Emison], James and Thomas request for writ ad quod damnun 1807

Description: The file contains documents related to James and Thomas Emisons request for a writ of ad quod damnun for their plans to build a mill on Marie [Mariah] Creek. On June 3rd, 1807, James and Thomas Emison applied for a writ of ad quod damnun for a mill and dam they planned to build on property of Donation Land # 42 on Marie[Mariah] Creek. The writ was issued by Robert Buntin, Clerk on September 7, 1807. It summoned to impanel a jury to determine what damages might be caused if a dam and mill were to be built on Marie [Mariah] Creek at Donation Land # 42. Parmenas Beckes executed the writ and returned the jury verdict to the Clerks Office. The jury met at the property of James and Thomas Emison on September 3, 1807. They assessed for the abutment of a dam for a water mill. The verdict read that if the water is not raised more than 8 feet in the bed of the creek, no damages should occur to others property. The verdict was signed by James Scott, Peter Jones, Daniel Hayes, Dan Sullivan, Noah Purcell, Mathias Bass, Jonathan Welton, John McDonald, John Wallace, William Bruce, William Purcell, and David Drake. The court costs for James and Thomas Emison for the writ ad quod damnun 1807 July Term $2.31 1/2 1807 November Term $4.95 Total $7.94 1/2.
