Joshua Hiland, admin. of William McCoy deceased vs Robert McCoy, James McCoy, and Alexander McCoy 1849

Description:	The file contains the complaint filed by Joshua Hiland, administrator, of the William McCoy estate against Robert, James and Alexander McCoy. He asked for collection of $400 debt and damages of $300. Also included are a summons for the defendants, a Promissory Note of the Defendants to William McCoy estate, and a note to the Clerk of the Court by Thomas and Jones, attorney for the Plaintiff. Attorneys Thomas and Jones filed a complaint for Joshua Hiland, administrator, of the William McCoy estate against, Robert, James, and Alexander McCoy. The complaint was for debt of an unpaid Promissory Note for $133.61 2/3 and asked for damages of $400. A summons for Robert, James, and Alexander McCoy was issued by William R. McCord, Clerk, for the defendants to appear in court during the June Term 1849. The summons was executed by John Westfall, Deputy Sheriff, for William T. Scott, Sheriff. Fees of $1.96 were assigned to the summons. A Promissory Note and a copy of the note were also included in the file. The Promissory Note written on March 28, 1846, promised to pay Joshua Hiland, administrator, of William McCoy estate, $133.66 2/3 and signed by Robert, James, and Alexander McCoy. On the back of one note listed the payments made on the note totaling $70.75. On the copy of the note the following was written on the back. Debt $133.66 2/3 + $59.09 = $192.75 2/3 + Damages $13.69 Total $206.44. A note from Thomas and Jones, lawyers for the plaintiff indicated the debt of $400 and damages of $300, and was filed by W.R. McCord, Clerk on May 30, 1849.
