The file contains documents regarding the suit Isaac Whitelsey brought against Horace Shepard the administrator of Robert Benefiels estate in 1843. Included is the complaint of trespass, two account sheets, a summons for Horace Shepard, and two receipts. During the May Term 1843, Isaac Whittelsey filed a complaint of Trespass against the administrator of Robert Benefiels Estate. His lawyer, Samuel Judah, wrote that Robert Benefiel received goods and merchandise worth $55 from Whittelsey. He had not received this sum of money from Benefilel when he was alive, he had not received the money when Mary Benefiel became the executor of Robert Benefiels estate. Since Mary Benefiel had died, he was asking Horace Shepherd as the administrator de bonis non of the Benefiel Estate to pay the account. One account sheet from 1836 indicates that Robert Benefiel owed $48.31 to Isaac Whittelsey for some of the following items: 32 1/2 yds calico, 3 green handkerchiefs $.94, 4 yds black cambric $.75, 2 small pitchers $.50, 1/2 gallon turpentine $.75, 1 sett [set] plates $.37 1/2, 1 dozen cups and saucers $.37 1/2, 5 yds green muslin $1.00, 4 butter plates $.25, 37 3/4 yds factory [material], chamber pot $.50, pocket book $.06 1/2, 3/4 yd brown holland [material], 2 1/2 yds green flannel $1.25, a lot of china and wash bowl $12.00. On the back of this sheet, Henry Buntin signed a deposition before Martin Robinson, that the account was accurate. On a second account sheet, the items purchased on the Benefiel account totaled $48.13, then credits of the following were added: 16 1/2 yd linsey $8.25, 5 1/2 lbs butter, 3 1/2 lbs butter, cash $29.75. This reduced the account to $18.38. A summons was issued by W.R. McCord, for Horace Shephard to appear in Probate Court during the May Term 1843. It was executed by Sheriff, Abraham Smith, with $1.20 in fees attached. Isaac Whittelsey wrote a note stating that he assigned the Judgement of $48.21 to Samuel Judah. On the back of the note, Samuel Judah stated the judgement was reduced to $12.81. On another note, Whittelsey, had an account to pay Robert Benefiel for keeping a sorrel horse $12.00 and on the back of this note read settled by payment of six dollars on account, August 1843. H. B.
