The file contains documents related to the plea of debt that Elizabeth Mason the administrator of John Masons estate brought against Isaac Watson and Antoine Marchall for fifty dollars. The file contains court transcript, promissory note, summons, and affidavits. In March 1834, Elizabeth Mason brought suit against Watson and Marchall in a plea of debt for a promissory note of fifty dollars. She was represented by attorney, John Law. The Defendants, Isaac Watson and Antoine Marchall, were represented by Attoney Abner T. Ellis. The Defendants claimed the Promissory Note was destitute because it was written when they were to purchase Lot # 484 by Johnson and Emmison Survey from John Mason. They stated that John Mason never conveyed the title to Isaac Watson in his life time. They also stated that since Masons heir was his three year old son, they were unable to procure the title. Martin Robinson issued summons for the following: Isaac Watson, Antoine Marchall, John Shields, Samuel Miller and Mary Miller. The summons were executed by John Purcell and recorded by clerk, A.D. Scott. Included in the file is the Promissory note written on September 19, 1833. A deposition by Antoine Marchall as to why he missed court, and the arguments of both attorneys. |
