George Davis, adm, for Dr. Henry Davidson, deceased vs Andrew Berry

Description: The file contains the documents relating to the plea of trespass, George Davis, administrator of Dr. Henry Davidson estate, brought against Andrew Berry for damages of fifty dollars. The defendant did not pay a bill since his son was not cured. Included are summons, court record of the transfer to Probate Court and Dr. Philip Bartons of Washington, Indiana, deposition. August 17, 1833, a bill was presented to the court indicating Andrew Berry owed fifty dollars for the curing his son. Martin Robinson transfered the case to the Probate court. Andrew Berry was summoned to appear in court on August 24, 1833 to answer to Daviss plea of trespass for fifty dollars on the Henry Davidson estate. The summons was issued by Martin Robinson and executed by Zack Pulliman, CKC. A request for a summons for John C. Clark as a material witness and a summons for John Erwin were requested by John Law, attorney, on behalf of the Plaintiff. Robert G. McClure was summoned to testify for Andrew Berry. The summons were issued by A. D. Scott, Clerk, and executed by John Purcell. Andrew Berry, questioned Dr. Philip Barton, during his deposition taken in the Daviess County Court before W. G. Cole, J.P. on February 12, 1834. When asked if Dr. Bartons treatment of his sons skin affection was cured, the Dr. replied that it had not been cured. His fee was to be based on whether the treatment worked or not.
