John Davison and Reuben Van Pelt vs Henry P. Brokaw, admin. of Stephen P. Striker deceased 1842

Description: The file contains the documents relating to the suit Davison and Van Pelt filed against the Stephen Striker estate for Trespass due to money owed on two judgements from the Supreme Court of Judication of Hunterdon County New Jersey in 1836. Included in the file are two court transcripts relating to judgements against Striker and Maxwell and Co. awarded in Flemington, New Jersey. Also included are the two Promissory Notes written to Talmage and Van Pelt Co. two insufficient funds notifications when the notes were presented, depositions stating the documents and signatures are authentic, and a listing of the creditors of the Striker Estate. The first court transcript from Hunterdon County, New Jersey documents the suit Thomas G. Talmage and Tunis Van Pelt brought against Stephen Striker, Amos Maxwell , and David Sivis. On April 1, 1836, Talmage and Van Pelt doing business as Talmage and Van Pelt, filed a Plea of Trepass on debt of $1,036 for goods, wares and merchandise delivered to Striker and Maxwell and Company. Summons were issued and the defendants appeared in court represented by attorney, James N. Reading. Talmage and Van Pelt were represented by attorney John W. Mann. On October 25, 1836, the plaintiffs were awarded $537.45 with an additional $40.18 in costs. A total of $577.63. The transcript was witnessed by Judge Joseph Hornblower and Clerk Zachariah Rosselle. Attached to this transcript was a deposition by Tunis Van Pelt stating $200 had been paid on the judgement, no further credit was extended to the defendants and $374.88 was still owing. The second transcript is also from the Hunterdon County, New Jersey court. Talmage and Van Pelt sued Stephen Striker and Amos Maxwell on another Plea of Trespass for a debt of $650. The attorney for the plaintiff was John Mann while James Reading represented the defendants. November 1836, the court awarded $334.85 and $40.18 in costs to the plaintiffs by Chief Justice Joseph Hornblower. On the back of the cover sheet is written: Balance due $243.02 Interest May 6, 1839 to February 16, 1842 $40.45 Total debt $283.47. Attached to this transcript is a deposition by Tunis Van Pelt, New York, New York, stating that, the sum of $188.26 had been paid on this judgement, credit had been stopped and the sum of $243. 02 and interest was unpaid. The deposition was sworn before Judge David P. Ingraham and attested by Joseph Hoxie, Clerk of the City and County of New York, October 7, 1839. Document three was a Promissory Note for $308.46, Flemington, New Jersey, October 10, 1835. It was written to Davison and Van Pelt and was to be paid with 90 days by Striker and Maxwell. On the back of the note: Pay to the order of John Law by Davisin and Van Pelt. A second copy of the Promissory Note was attached to a bank notice of insufficient funds. The notice reported that Charles Dayton, Notary called at the office of the bank at New Brunswick and Cashier, P. Spader reported the drawer had no funds. On December 12, 1835 a protest was filed against the drawers. On the back of the notice, Striker and Maxwell $308.46 ; Protest $1.50. Filed February 17, 1842 by Clerk, W.R. McCord. A second notice of insufficient funds was filed on January 11, 1836 by Charles P. Dayton. Also included is a statement of the claims allowed in favor of the creditors of the Estate of Stephen P. Striker at the February Term of the Probate Court of Knox County 1842. Henry P. Brokaw Claim allowed $84.75. Trowbridge and Nichol Note $585.72, Davison and Van Pelt Note and Interest $915.57, Duff Acct $150, Lush Lathrop and Co. Acct $660.83, Joseph Johnston and Jonathan Higgins Judgement $936.38, Joseph Haines $1488.96, Talmage and Van Pelt $283.47, Talmage and Van Pelt $437.34 for the Total Debits: $4,732,11.
