Description: Court Transcript of the suit of Gabrial Godfroy and executor of Agatha Paupards estate, who was the executrix of Joseph Paupards estate vs. Pierre Gamelin the executor of the Antioni estate. The transcript was written by Robert Buntin, Prothonotary. Gabriel Godfroy sued a writ of Summons against Pierre Gamelin in a plea of Trespass to appear in the February Term 1803. The writ was witnessed by James Johnson and executed by Sheriff, William Prince. The February Term 1803, Gabrial Godfroy, executor of Agatha Paupards estate. Agatha was the Legatee and Executrix of Joseph Paupards estate. Declared that Antoini Marie was indebted to Joseph in the sum of six thousand and fifty-two livers, five sous (one thousand eight dollars and seventy cents) by a promissory note written June 21, 1793. The note had not been paid by Marie nor by Gamelin after Maries death. The Plaintiff asked for three thousand dollars in damages. The Plaintiff bought the Will and Testament of both Agatha and Joseph Paupard to court. Pierre Gamelin filed his plea or answer to the Declaration. Pierre Gamelin adverse Gabrial Godfroy. He says that he hath fully administered all and singular the estate and has nothing of Antoine Maries and was ready to verify. Gabriel Godfroy ought not be barred from having and maintaining his action against him as the administration. Pierre Gamelin. Godfroy, by his lawyer, John Johnson filed his Replication, Gamelin has not fully administered a part of the estate in the possession of Gamelin and asked Inquiry of the county. The Court not being sure of the damages ordered that an Inquisition be made by the Sheriff. May Term 1803, the Sheriff, William Prince by virtue of a writ of Inquiry done in April, Gabrial Godfroy, Executor hath sustained damages by reason of the promises expand to one thousand four hundred and twenty-three dollars and fifty cents. Also seventeen dollars and eight-six cents for cost and charges. Damages in whole are one hundred and forty-four dollars and thirty-six cents.
