Obediah Newman, adm., of Daniel McGaughey, dec. vs James Baird

Description:	Court transcript written by Robert Buntin for the suit Obediah Newman, the administrator of Daniel McGaugheys estate, brought against James Baird. He sued for non payment of salt delivered to Baird by McGaughey and asked for five hundred dollars in damages. Obediah Newman sued for a writ of Capias ad respondendum against Joseph Baird to answer to his plea of Trespass and to damages of five hundred dollars. The Writ was witnessed by James Johnson and executed as directed. August Term 1800, Obediah Newman was represented by Henry Hurst and Joseph Baird by Robert Hamilton, the cause was continued. November Term 1801, both Parties were present with their attorneys. The Plaintiff complained that Joseph Baird, in custody, received twenty-four barrels of salt from Daniel McGaughey on August 9, 1799. He was to pay McGaughey for the salt or return the salt. According to Newman he did not pay for the salt or return the salt to McGaughey during his life time, nor pay or return to Newman, since the death of McGaughey. The dispute was referred to arbitration, by William Mills, John Ockeltree and Jacob Kuyhundall. David Floyd, General Washington Johnston, and Benjamin Park were the individuals who wrote the arbitration. They ordered that the Defendant pay the Plaintiff the sum of two hundred and eighty-four dollars and eighty-three and one third cents, charges and costs. At the bottom of the transcript was written, The Clerk of the General Court upon issuing a writ of Error in above case will direct that it be obeyed as Supersedes upon the defendant or sufficient securities on his behalf entering into bond to the plaintiff in the usual manner in the sum of five hundred dollars.
