James Dick vs Andrew Purcell

Description: A Bill of Exceptions was filed August 12, 1839 by Christena Dick in open court before R. N. Carnan, Probate Judge. It was shown that she is a minor aged 17 and that Alexander Dick should be appointed her guardian of person and estate. The motion was objected to by Andrew Purcell who claimed to be one of the executors of the will of Thomas Dick, deceased, under which she is a divider. A will and probate were produced. The will does show Andrew Purcell to be one of the executors and auditors. It is also discussed that Christena Dick is not the legitimate child of Thomas Dick, deceased. Christena Dick states she objects to Andrew Purcell being appointed her guardian. The court appoints James Dick as her next friend. The court also orders the bill to be sealed and made part of the record. The document is signed by R. N. Carnan, Judge. James and Alexander Dick are firmly bound unto Andrew Purcell for the sum of $100. They bonded themselves as heirs, executors and administrators jointly as a friend of Christena Dick. Andrew Purcell is appointed guardianship of the estate of Christena Dick, infant daughter of Thomas Dick, deceased. The document is filed September 10, 1839.
