Nathaniel G, Myers and wife Sally Ann vs Elizabeth Myers, Mary Ann Myers and Mary Myers guardian of Mary Ann Myers

Description: During the June term 1850 a petition by plaintiff Nathaniel G. and his wife Sally Ann Myers petition defendant Mary Ann, Elizabeth and Mary Myers, widow of John Myers, and guardian of Mary Ann, for land entitled to them by right of 1/3rd property of the late John Myers and they ask for the land to be partitioned and for Mary to receive her dower rights from donation 164 T. 2 N. R. 9 W. containing 66 33/100 acres and 50 acres part of donation #9 and 200 acres part of donation 165 T 2 N. R. 9 W. M. R. McCord asks the sheriff to summon Elizabeth Myers, Mary Ann Myers and Mary Myers to court. They are to appear the 2nd Monday June 1850 to answer to a bill of complaint by Nathaniel and Sally Ann Myers. The document was signed May 17, 1850 by W. R. McCord. W. R. McCord is appointed guardian for Mary Ann Myers. He states she knew nothing of the petition against her. On June 11, 1850 George Calhound, John Westfall and Joshua Hiland are appointed as Commissioners to make partitions for 1/3rd property each and to partition dower rights for Mary Myers and they take an oath to do their duty on June 21, 1850. The Commissioners report gives Elizabeth Myers 98 and .075 acres in the South corner of donation 165 and 25 acres more or less N. E. half of 50 acres set off to the heirs of John Myers in the partition of a part of the real estate of Frederick Myers deceased. Nathaniel and Sally Myers are given 98 .075 acres in the corner of donation lot 165 and 25 acres S. W. half of 50 acres set off to heirs of John Myers by partition of Frederick Myers estate. Mary Ann Myers is given 62 1/2 and .087 acres in the W. corner of No. 9. Mary Myers, widow of John Myers, is given as her dower rights 87 .050 acres. The document is signed by George Calhound, John Westfall and Joshua Hiland with costs of the wages for each for 3 days.
