Pierre Boger, guardian of Joseph Boger, estate and person and Pierre Richardville vs Pierre Boger Jr. and Mary Ann Laderoute Boger

Description: An indenture made November 15, 1841 between Francis Boger and Mary Laderout Boger, his wife, and Pierre Richardville, Gabriel Boger and Joseph Boger, minor children of Louis Boger, deceased is filed. Parties in the first part paid the sum of $100 for 34.400 acres of land in survey #17 Town #2 N. Range 10 W. The land said Louis, deceased, did sell to Francis Boger who purchased the land at a partition sale on November 27, 1840. Francis Boger was appointed guardian of Pierre and Gabriel Boger and paid $100 guardianship bond on November 14, 1839. The guardianship papers were signed by Francis Boger and Mary Boger before B. M. Thomas and William W. B Carrs. A complaint by B. M. Thomas attorney on behalf of Pierre Boger, guardian of Joseph Boger, estate and Pierre Richardville vs Pierre Boger Jr. and Mary Laderout Boger is filed. The complaint before Judge James Thorn states that on November 15, 1841, Francis Boger was appointed guardian of Joseph and Gabriel but has died insolvent, and that the guardianship and mortgage are combined in the complaint. Pierre Richardville has now been placed as guardian. Mary Laderout Boger states that Francis paid the minor Joseph $80 on January 27, 1840 for the property that was mortgaged. They also state that Gabriel has died insolvent. Attorney B. M. Thomas complains and asks defendants be required to account for and to pay the sum due with interest and that the land be sold. A subpoena is issued on June 26, 1847 for Pierre Boger Jr. and Mary Ann Laderout Boger. They are to appear on the 5th Monday in August to answer to a bill of complaint of Pierre Boger, guardian of Joseph Boger estate and person, Joseph Boger and Pierre Richardville is filed. The response to the complaint by Pierre Boger Jr. minor child through his guardian W. R. McCord is filed. The guardian says that Pierre Boger knows nothing of the complaint sworn September 8, 1847. A decree of court orders says that $261.50 plus interest from January 27, 1840 shall be paid to the clerk within days of the decree by defendants. It also states that the defendants are prevented from all equity of the land in said mortgage being the 32 acres bought from Louis Boger that minor Pierre did seize and which Francis did purchase from Louis Boger on January 21, 1841 and that Mary Ann did claim as her dower rights.
