Charles Scott vs Abner Hynes

Description: During the November term of 1812, Charles Scott sued Abner Hynes for $75 plus $50 damages on a promissory note that was received on September 15, 1812. A writ of Capias ad Respondeum is issued on Abner Hynes on December 19, 1812. On the back of the writ it states that bail is required, it was executed on David L. Gregg who makes an appearance on bail. Sheriff James Crow delivered the bail bond on Abner Hynes and David S. Gregg. The writ states they are bound to Sheriff James Crow for $150. On December 18, 1812 plaintiff appears in court and gives testimony, saying defendant has refused to pay the promissory note that was received on Sept 15, 1812 so he is also asking for damages. Several continuances are issued. On January 26, 1814 R. Buntin files a writ on Abner Hynes and David Gregg ordering them to court on March 18, 1814 to pay amount due Charles Scott $75 plus interest from December 19, 1812 until paid. On back of the writ B. V. Beckes, Sheriff says he could not deliver writ due to absence of defendant. On March 18, 1814 a writ of execution is filed against the defendant asking them to be taken in to custody and to be brought before the court to satisfy debt of $75 plus interest plus $10.86 1/2 plus 50 cents for writ delivery. R. Buntin, Clerk signed and filed writ. Bail was executed on Hyacinth Lassalle, J. Bond, and Abadiah Flint. Bail is on a repletion bond which was delivered by Deputy Sheriff H. J. Mills. The replevin bond states that David L Gregg, Joshua Bond, Hyacinth Lassalle, Abadiah Flint are jointly held and firmly bound unto Charles Scott for $190 to be levied on their respective goods, chattels, lands and tenements if found in default. A copias ad satisfaciandium is issued by Charles Scott against Abner Hynes, David S. Gregg his appearance, bail is set for $92.11 1/2 interest plus cost. David Gregg, J. Bond, Hyacinth Lassalle, and Abiadiah Flint or one of them or their heirs, executors or administrators shall pay and satisfy the said Charles Scott or his heirs the sum of $92.11 1/2 plus interest from this date plus sum of $5.35 the sheriffs commission and fees there of for this replevin bond of April 1, 1814. On the back Sheriff Benjamin v. Beckes states he has $100 by virtue of the writ, R. Buntin, Clerk, files a copy of proceeding on December 14, 1814.
