Knox County court record for Indiana vs. Gordon, Gordon and Hubs, 1856

Description: Folder 7780 in Box 148 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House contains eight documents in the case of State of Indiana vs. Andrew Gordon, Albert Gordon & Robert Hubs. On February 25, 1856 Isaac Griffin under oath complained to Justice of Peace R. McClure that on February 23, 1856 he, Griffin had been assaulted and battered by Andy Gordon, Albert Gordon, and Robert Hubs, all men of color, and described the weapons they had used against him. He also stated that if it had not been for Joshua Davis, a man of color, they would have killed him. Griffin wanted the three men arrested and held accountable. J. P. McClure issued an immediate warrant for their arrest and it was carried out. The Gordon’s posted the required recognizance of fifty dollars and Hubs failing to enter into recognizance was committed to jail. Witnesses for plaintiff were subpoenaed and included John Davis, Joshua Davis, Henry Brandy (possibly Brodie or Broadie), John Armstrong, Jonathon Welton, William Hodgen (or Hodgens), Irvin Hogue, Alfred (last name unreadable.) There was a jury finding of one defendant as guilty for assault and battery, but not guilty of intent to kill. The name of the defendant is not on the document. The documents found are the complaint, arrest warrant, summons for witnesses, recognizance for the Gordons, transcript, recognizance for Griffin, verdict of jury, and a bill for fees due for the constable’s work.
