File 3868 in Box 70 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House contains nine documents in the case of Dunwoodie vs Newton. This was a debt litigation case whereby on December 7, 1830 William Dunwoodie sued Nathaniel Newton, a man of color for $99.50. The plaintiff Dunwoodie called for a subpoema for Clark Boge (Bogue) and Jessie Busey, a man of color. The defendant called for a subpoena for William Harper, Horace Sheppard (Shepherd), Jerod Shippy, John Camp and Noah Ashley. On December 13th the plaintiff stated his case and the defendant’s attorney, George Ewing appeared with defendants plea that he did not owe the money. The plaintiff plead for a continuance and said he was not ready for trial for want of a material witness, so the case was continued until December 28th. On December 24, the plaintiff called for a subpoena for a Clark Boge and John Allen. On that same date, after hearing testimonies it was considered that the plaintiff would recover from the defendant thirty silver dollars with interest and costs. On January 14, 1831 Newton called for an appeal and filed his bond for security. On March 9, 1831 Dunwoodie asked for a continuance stating he had another witness, David Dunwoodie who was a resident of Ohio and was difficult to bring in until the next term of the court. There is no further information as to how the case ended. The documents in the folder consist of the affidavits, court transcript, defendant plea, subpoenas, and appeal bond. |
