Folder 2747 in Box 49 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House holds three documents in the case of Judah vs. Wm. Small, administrator of deceased John Small. William Small had Judah arrested after she, an indentured servant, absconded from him. She was placed in jail with no charges. Judah filed for a writ of habeas corpus so she could go to court and be freed. She was granted a hearing before Justice of the Peace, John Reiley. After Reiley heard her comments and then heard William Small testify against her, she was found guilty of running away and remanded back to jail until returned to her new owner, William Small. She wrote a letter of objection to the finding and listed four reasons why she should never have been arrested and cited included the Territorial Legislation and Ordinance of 1787. The documents include her petition, finding of the justice of the peace, and Judah’s objection. |
