Folder 2676 in Box 47 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House holds 7 documents in the case of Kinney vs. Graeter, 1821. This case is a claim of assault and battery on Amory Kinney. While visiting the home of Homer Johnson, Kinney was asked to come outside by Samuel Parr who wanted to speak with him. When he was returning to the house Kinney was stopped by Christian Graeter who presented him with a writ of habeas Corpus issued by the court for Graeter to bring before the court Prince Graeter, a man of color who was in the custody of Graeter. When asked by Graeter if it was his hand writing on the writ, Kinney said it was. Graeter seized him by his arm and cried out to another man present, William Lagow to take hold of Kenny’s other arm which he did, pulling him a few feet from the door. Graeter proceeded to assault and commit battery on Kinney with a cane, hitting him on his head and other parts of his body causing injuries. Then Graeter threatened him against going to court to advocate for Prince Graeter’s cause, telling him that if he testified he would not leave the borough alive. The documents consist of the affidavit and testimony of Kinney, warrant for Graeter’s arrest, a request by Kinney for a change of venue, a court document granting change of venue issued to Kinney, subpoena for witnesses, a schedule of court costs and papers sent to Sullivan County Circuit Court. Witnesses included Willis Fellows, James Nabb, Nathaniel Ewing, Stephen Striker and William Meure. |
