United States and William McIntosh vs. Simon Vandersall, 1815

Description: File 84 can be found in Box 2 of the Knox County Compete Records. On March 3, 1815 William McIntosh comes to court and files suit against Simon Vandorsall. A writ is executed by Sheriff B.V. Beckes on March 8, 1815. The writ is to be placed on Simon Vandarsall to be taken into custody for an action of debt. No bail is required. The write is signed by B. Ferguson. In the complaint against Simon Vandorsall the plaintiff says the defendant owes them $1000 debt and $1000 damages for the infraction of an act of introduction of Negroes and Mulattos into this territory. General W. Johnston is the attorney for the plaintiff and William Prince is the attorney for the defendant. An indictment is filed against Simon Vandersall for taking Lydia, a woman of color on the date of June 28, 1815 from the Knox County area without registering her at the clerk’s office. A jury trial is held. Simon Vandorsall files for a retrial saying the oral evidence of Justice Stout, which was found in defect of certificate of Elihu Stout as to a make sufficient justification for debt for removing Lydia out of the territory or a fugitive of labor was not entered into evidence. Simon Vandarsall files an exception in June 1816 term. Judgement is that the defendant pay debt owed plus cost and charges by them. Filed July 30,1816
