Folder 1578 in Box 25 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House holds documents in the case of William McIntosh vs. Simon Vanorsdal in which William McIntosh sued Simon Vanorsdal for $273.50. The documents include 1 summons, 1 court cost bill, two dedimus, a deposition, a certification, two receipts, two notices, a subpoena, and a complaint. The summons called for the sheriff of Knox County to bring Samuel Vanorsdal before the judges of the Circuit Court to answer unto William McIntosh in a plea of trespass. The summons, dated March 8, 1815, was witnessed and signed by court clerk Robert Buntin and executed by sheriff Benjamin V. Beckes at a cost of $.59 cents. The court cost bill totaled $22.99 1/2 cents. The first dedimus requested any justice of the peace in the Illinois Territory to take depositions related to this case. The dedimus, dated May 5, 1816 was signed by court clerk Robert Buntin. The deposition was taken by John Hay, Justice of the Peace in St. Clair County, Illinois Territory. Nicholas Jarrot swore that on October 10, 1814, in the town of St. Louis, he paid Simon Vanorsdal $500 for an indentured Negro woman named Liddy. The deposition was signed by Nicholas Jarrot and witnessed by John Hay. A note on the verso of the deposition gives the date as May 27, 1816. The certification, dated May 27, 1816 is signed by John Hay and states that he is an acting justice of the peace. A receipt dated October 10, 1814, indicated that the defendant Vanorsdal received $500 from Nicholas Jarrot for the sale of Liddy. Jarrot made the purchase for William McIntosh. Vanorsdal signed the receipt. A notice by Raphael Widen states that on Monday May 27, 1816, he would take depositions at the home of John Hay in Kaskaskia, Illinois Territory. A note on the verso of this notice states that this is a true bill and is signed by Joseph Trotier. The second receipt relates that Vanorsdal received $273.50 through the hands of Jones and Dubois and is signed by the defendant Simon Vanorsdal. The complaint by William McIntosh states that the defendant was indebted to him for $273.50 in September 1814. The complaint was signed by the plaintiffs attorney General Washington Johnston. A date on the verso of the complaint was March 2, 1815. The second dedimus called for any justice of the peace in the Illinois Territory to take depositions for this case, which was to be held on the first Monday of March 1816. This dedimus, dated February 2, 1816, was signed by court clerk Robert Buntin. The verso of this dedimus was signed by John Hay. |
