A promissory note by Frederick Sholts in the amount of $101.08 1/2 owed to Sarah Patterson is presented. Witness to the note is Thomas White. William Gamble states that $24 was paid on the account on September 12, 1814. During the June 1815 term Stephan Haynie complains for his wife Sarah Patterson against Frederick Sholts in custody on a plea of trespass. Whereas Frederick on July 14, 1814 at Vincennes was indebted to Sarah $110.08 1/2 that was to be paid by defendant to Sarah through notes upon the Rangers. Payment when they were paid in October 1814 but they failed to do so. On November 1814 he promised to pay Sarah the debt but has failed to do so. She by her husband Stephen Haynie puts in his place General Washington Johnston. An order, dated June 2, 1815 is filed. The Clerk is to send a subpoena to Frederick Sholts to appear in court on Monday June instant. He is to answer unto Stephen Haynie in rights of his wife formally Sarah Patterson in a plea of trespass and damages for $150. The Sheriff of Knox County to take bail for $76.84 as $25 has been paid out of original sum per G. W. Johnston P. Q. The summons was executed by B. V. Beckes with William Jones having special bail. A memorandum of special bail is filed the 2nd day of June 1815. William Jones of Knox County personally appears before B. V. Beckes, Sheriff and undertook for F. Shoults at the suit of Stephen Haynie on an action of debt for $76 now pending in the Circuit Court of Knox. F. Shoults to appear the first Monday in June instant to answer to the said suit and Shoults will pay and satisfy the court or render himself to prison in execution of the same or William Jones will do it for him. Dubois signs as witness and F. Shoults and Will Jones sign for bail. A scire facias to revive the suit is filed June 1816 and executed by giving notice in the presence of Owen Riley and James Sprowl by B. V. Beckes,Sheriff. The cost to serve and return is listed as $.46 1/2. The transcript of previous subpoenas, summons and actions of court plus new information during the continuance of the death of Stephen Haynie is filed. Stephan died March 1816 intrastate and the suit remains undecided. Sarah now brings suit against Frederick Sholts. A cost of court bill is filed for the dates of June 2, 1815 to June 1816 in the amount of $13.80. The case is continued as Patterson, Sally vs Frederick Shoults. Sarah Patterson Haynie receives $30.46 in judgment. |
