The file contains six documents related to the suit Abraham Decker brought against John Spede (Spade), John Pea, and Jacob Pea, Junior in a plea of trespass vi et armis and damages of five hundred dollars. Included is a summons, one complaint, three subpoenas, an arbitration report, and the accounting of the court costs billing. A summons was issued for John Spede(Spade), John Pea, and Jacob Pea, Junior to appear in Circuit Court in Vincennes the first Monday in March next to answer unto Abraham Decker in a plea of trespass vi et armis and damages of five hundred dollars. It was witnessed and issued on the 3rd day of November 1815 by Robert Buntin, Clerk CCKC and executed by B(Benjamin) V. Beckes, Sheriff KC with $2.13 court cost fees added. A complaint was filed during the March Term 1816 by Abraham Decker. It complained that John Spade, John Pea, and Jacob Pea Junior in custody, on 31st of October 1815 at the plantation of Decker, in Harrison Township with force and arms: horses, oxen, waggons and carts broke and entered fencing of the Plaintiff and threw down the same and trampled, destroyed a quantity of wheat and other small grain. They also trampled down and carried away and destroyed a quantity of corn to damages of $500.00. Decker put in General W. Johnston as his attorney in this suit.Walter Willson, Thomas Johnston, Starnator and Will Beckes were subpoenaed to appear the first Monday of March to give evidence on behalf of Abraham Decker. This writ was signed by Robert Buntin, Clerk CCKC on the 24th day of February 1816 and executed by B. V. Beckes, Sheriff KC with $2.31 in court fees attached. A second subpoena was issued on the 24th day of February 1816 by Buntin. It was for Daniel Decker, Abraham Decker and Nancy his wife, and Elijah Mays to appear on the first Monday of March before the Circuit Court in Vincennes. They were to give evidence on behalf of Abraham Decker. The writ was executed by B.V. Beckes, Sheriff KC with $2.29 fees attached. A subpoena was issued for Peter Fredrick, Hetsey Decker, and James McDanniel to appear in Circuit Court in Vincennes on the first Monday in March on behalf of John Spede (Spade). This writ was executed on Hetsey Decker and Peter Fredrick but McDanniel was not found. The Arbitration Report stated that arbitration was held at the house of John B. Drennon, a Justice of the Peace. It was ordered that the Defendants, Spade, Pea, and Pea pay the Plaintiff, Decker, the sum of four dollars and twenty-five cents by way of damages, and the cost of the suit. This was done on Saturday, 18th day of May A.D. 1816 and signed by Walter Wilson, the mark of Phillip Catt, Isaac Miner, and William Baird. The court cost bill account totaled $19.96. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 page 302: June Term 1816 the Parties appeared and the arbitration report read. It was ordered that he Defendants pay the four dollars and twenty-five cents damages and the court cost to the Plaintiff. |
