White, Sally wife of Francois Marshall vs Thomas White

Description: An appeal bond is filed for Thomas White and Charles Thorn of Knox County. They are to be firmly bound unto Francois Marshall, husband of the late Sally White in the sum of $40. The money is to be levied on their goods and chattels if in default. The condition of the case bond is that where as judgment has been awarded against the said Thomas White in favor of Sally White on 30 May 1812 on a case before John B Drennin, Justice of the Peace for Knox County. Should Thomas White appeal to our next Circuit Court to be held and determination of the court then above to be void and judgment to remain in place. The appeal is dated May 25, 1815 and signed by Thomas White, Charles Thorn and witnessed by Charles T. White and J. B. Drennin. An appeal is filed June 3, 1815 on the case of Sally White vs Thomas White. A transcript of Thomas White to Sally White is presented. The transcript listed 2 large salt kettles at $10 each for $20.00. Sarah White demands $20 of Thomas White and case is sent to trial. A summons is issued March 18, 1815 to the Constable of Harrison Township. He is to summon Thomas White to appear before the Justice of the Peace to answer unto Sarah White on a plea of trespass for $40. The summons was signed by J. B. Drennin, Justice of the Peace and returnable March 25, 1815 by Jonathan McBain, Constable of Harrison Township. The parties failed to appear and trial is deferred until the 8th day of April 1815. A subpoena is issued on April 4, 1815 to the Constable of Harrison Township. He is commanded to summon William Minor to appear before J. B. Drennin, Justice of the Peace of Knox County. He is also ordered to keep the peace. The subpoena is filed April 8, 1815. Minor is to appear at Drennins house to testify on the part of the plaintiff on an action of trespass where Sarah White is plaintiff and Thomas White is defendant. The subpoena was returned April 8 1815 and executed 3 1/2 miles. By agreement of the parties the trial is deferred until April 22, 1815. The parties fail to appear and the trial is deferred until May 6, 1815 by agreement of plaintiff. By Agreement of the plaintiff the trial is continued until May 20, 1815. The defendant fails to appear and plaintiff pleads for justice by trial and is granted trial. George Leech and William Minor are sworn to give evidence. The court decides that plaintiff recovers of defendant $20 with interest of 6 percent from May 20, 1815 until paid with costs of suit. The cost to serve is listed as $2.58 3/4. The document is signed May 26, 1815 by J. B. Drennin, Justice of the Peace. A summons is issued for George Leech and William Minor to come to court the first Monday of September instant to give evidence on behalf of Sarah White plaintiff against Thomas White, defendant on an appeal. A $100 fine will be applied for failure to appear. The summons is dated September 4, 1815 and signed by R. Buntin, Clerk as witness. A note on back states they are to appear on the 5th day of term with service and mileage and return being $1.46. A summons on appeal for defendant is filed. The Sheriff is commanded to summon John Marshal and John Francis Leech to appear before the Judges of the Circuit Court on the 1st Monday of October next to give evidence on behalf of Thomas White, defendant on suit of Sarah White plaintiff on an appeal. A $100 penalty will be applied for nonappearance. The summons is filed September 18,1815 by R. Buntin, Clerk and executed on George Leech only as Marshall could not be found per B. V. Beckes, Sheriff. The cost to serve, mileage and return being $.88 1/2. A Cost of Court bill is filed. The dates are from June 1815 to October 1815 in the amount of $10.45 1/2. R. Buntin received $6.00 and the attorney received $2.50. The case was dismissed and barred by Statue of Limitation. The defendant is to recover costs and charges.
