Heany, Sally, administrator of Squire Patterson vs. Lewis F. West

Description: This file contains the documents related to the suit that Sally Haynie, administrator of Squire Patterson brought against Lewis F. West over a debt of $35.23. The documents include 3 subpoenas, 1 court transcript, 1 recognizance bond, and 1 court cost bill. The first subpoena called for the sheriff of Knox County to bring John McBean (McBain), Etheldred F. Bass, and Samuel Setzer before the judges of the Circuit Court on the 4th Monday of May 1816 and give evidence on behalf of the defendant Lewis F. West. This subpoena, dated May 27, 1816, was witnessed and signed by court clerk Robert Buntin and executed by deputy sheriff James Jordan at a cost of $1.44. The 4 page court transcript by Justice of the Peace William Gamble noted that a warrant was issued on August 7, 1815 and returned on August 9. The defendant, West, appeared but the plaintiff, Haynie, did not appear because of sickness in her family. The case was continued until August 23, and neither the plaintiff or the defendant appeared. On October 7, 1815, the defendant appeared but his witnesses and the plaintiff failed to appear. On December 8, the plaintiff failed to appear on account of sickness, but the defendant and his witnesses appeared without being subpoenaed. A jury found for the defendant. The transcript stated that a promissory note dated November 8, 1813, from West to Squire Patterson, was for $22.25 and witnessed by John McBain. The plaintiff made his mark. A receipt for $12 from West to Patterson was dated February 19, 1814. Another promissory note dated November 8, 1813 indicates that West borrowed $23 from Squire Patterson. This note was witnessed by John McBain. The transcript then shows that Patterson received $2.00 in repayment on February 19, 1814. On December 21, 1815, William Gamble, Justice of the Peace, stated that the promissory notes listed in the transcript were true copies. The transcript next lists a summons dated July 31, 1815, commanding constable James Jordan to bring Lewis F. West before Gamble. Gamble then signed the transcript on December 21, 1815 stating that the summons was a true copy. A subpoena dated September 30, 1815 called for constable James Jordan to bring John McBain before justice of the peace Gamble on October 7, 1815. On December 21, 1815 Gamble noted that the above subpoena was a true copy. Another subpoena called for Jordan to bring John McBain before Gamble on December 1, 1815. This subpoena was signed by Gamble on November 25, 1815. A final subpoena in the court transcript called for constable James Jordan to bring John Adams, Etheldred Bass, William Williams, and Samuel Setzer (Sitzer) to Gambles home on December 8, 1815 to be jurors. Gamble certified that all of the documents in the court transcript are true copies. The second subpoena called for the sheriff of Knox County to bring John McBain, Etheldred F. Bass and Samuel Setzer before the judges of the Circuit Court on the last Monday of September 1816 to give evidence on behalf of the defendant Lewis F. West. This subpoena, dated September 13, 1816, was witnessed and signed by court clerk Robert Buntin and executed by sheriff Benjamin V. Beckes at a cost of $2.17 1/2 cents. Sally Haynie and Benjamin V. Beckes both acknowledged $11.15 to Lewis F. West on December 21, 1815. Haynie was appealing an earlier judgement against her under Justice of the Peace William Gamble. The court cost bill totaled $16.61. The last subpoena called for the sheriff of Knox County to bring William Gamble before the judges of the Circuit Court to give evidence on behalf of Sally Haynie. This subpoena, dated October 3, 1816, was witnessed and signed by court clerk Robert Buntin and executed by sheriff Benjamin V. Beckes at a cost of $1.00 1/2 cents.
