The file contains two documents related to the assault of Dici Spreadley, the step-daughter, of Simon (Zion) Morrice (Morris) by Patsey Scott. One document is the summons for Patsey Scott and the other is the recognizance bond of Abner Scott and Henry Kuykendall. According to the summons issued by Frederick Graeter, Justice of the Peace Knox County, on the 29th day of March 1815; Simon Morris appeared before him and complained that Patsey Scott did on Sunday 26th of March assault and unmercifully beat his step daughter, Dici Spreadley and he was fearful that Patsey Scott would do some further injury to Dici Spreadley. He requested sureties of the peace to be had and granted to Dic Spreadley against Patsey Scott. The Constable of Knox County was to take the body of Patsey Scott and bring her before a Justice of the Peace to find sureties for the Peace and her good behavior toward Dici Spreadley and other good citizens. On the verso, peace warrant 29th March 1815. executed $.50; deft present 12 miles $.48; total $0.98. P(Phillip ) Almy other costs totaled $1.53 1/2. The second document was the recognizance bond of Abner Scott, Rough Man of Fort Ellison (Allison) and Henry Kuykendall, Rough Man of the same place. They posted fifty dollars each to ensure that Patsey Scott would appear before the judges of the Circuit Court of Knox County and she would keep the peace toward all the good citizens and especially Dici Spreadley. The bond document was signed by Frederick Graeter, JPKC on 27th day of April 1815. According to the Minute Book of the Knox County Court of Common Pleas/ Circuit Court (1811-1817 pages 154, 179, 180, 181: in the cause of the United States vs. Martha (Patsey) Scott, personally appeared in open court, Lydia Allison, Julian Kuykendall, and Jane Allison and acknowledged themselves indebted to the United States for fifty dollars each. Henry Kuykendall, John Mills and John Allison their secureties and acknowledged to owe the United States the sum of fifty dollars recognizance and bound themselves to appear in court the first day of the next term in October to give evidence on behalf of the United States against Martha Scott. On page 179-181: The Indictment of Martha Scott for assault and battery on Nancy Morris; the defendant appeared and the indictment read to which she filed her pleas as not guilty as the place where the offense was to have occurred was not in the jurisdiction of the Knox County Court. She argued the incident occurred, Fort Allison, in the Illinois Territory and she asked for judgment. The prosecuting Attorney, William Prince argued that Fort Allison was in the Indiana Territory and he asked for judgment. The jury consisted of William Clark(e), Samuel Carruthers, George W. Sarter, John Weaver, Anthony M. Sanders, Thomas Emison (the foreman), William Armstrong, John Michel, Charles Archer, George Bogard, John McKee, and Pete Hollingsworth. They voted that Fort Allison was in the Indiana Territory and the Defendant answer to the Indictment. Martha Scott pleaded not guilty. The jury consisted of the same individuals and determined that she was guilty, pay a find to the Indiana Territory of two dollars and costs of prosecution and stand committed until the fine and the costs were paid. |
