The file contains numerous documents related to the suit Nathaniel Claypoole brought against Pierre Roux for damages he reported when Roux refused to load and transport Claypooles freightage from the Wabash Prairie to New Orleans. Included are the complaint, an affidavit, interrogatory, rebuttal responses, a deposition, 15 subpoenas and two court costs accounts. According to the complaint filed by Nathaniel Claypoole by his attorney, George R.C. Sullivan; Claypoole and Pierre Roux, made an agreement in May of 1813 for the transport of freightage. The agreement was for Roux to transport twenty-five tons of loading from Vincennes and other places on the Wabash to New Orleans. It was agreed that Roux should furnish the barge and take freight provided by Claypoole such as flour, bacon, Indian corn, hog lard, and venison hams to the City of New Orleans. Claypoole would also employ and and furnish two boatmen to assist Roux in the navigation. Claypoole further stated that he employed the two boatmen, and delivered the freightage, but Roux refused and neglected to accept the hands or receive the freight. This caused Claypoole to loose the profit and the damage of the freight. In rebuttal to this complaint, Roux reported the freightage was not delivered on time, nor did Claypoole provide the needed grain storage for the corn. The suit continued from the August Term 1813 until October Term 1815. The following individuals were subpoenaed to testify for Nathaniel Claypoole; Abraham F,. Snapp, Conrad Crum, Nathaniel Harnis, and George Claypoole as well as, Pierre Bonhaunery, James, Duncan, Thomas Emison,. Roux had the following to testify on his behalf: Manuel Roux, Francois Mallet, Thomas Coulter, Antoine Marchal, Marie Louis Sebastian (Marie Louise Ducharmel)and Elizabeth Goyeau. The case went before a jury in the June Term of 1815, the jury consisted of John Alton, Martin Rose, Frederick Claycomb, George A. Mc Henry, John Thickerton, James Hannah, Richard Bowman, Samuel Adams Jones, John Pumpherey, Abraham Westfall, William Garrad, and Elias Biedal, Jr. The jury could not agree and the case was continued. According to the Minute Book of the Knox Court of Common Pleas/ Circuit Court 1811-1817 during the October Term 1815 page 194, the parties appeared by their attorneys and the cause was abated by the death of the plaintiff. |
