Description: The file contains three documents related to the suit Jacques and Francois Lasselle brought against Ettiene Bizalion as the administrator of the Francois Bisalion estate to foreclose on a mortgage. One document is the mortgage, one a promissory note and one the summons for Ettiene Bizalion. The mortgage was made the ninth day of May 1809 between Francois Bisalion of Knox County and Jacques and Francois Lasselle of the District of Detroit and the Territory of Michigan. Francois Bisalion for a consideration of seven hundred and thirty dollars and seventy-five cents to be paid to Jacques and Francois Lasselle on the certain house and lots of ground where Francois Biszloin now lives in the Village of Vincennes and purchased of Toussaint Dubois. Signed by the mark of Francois Bisalion witnesses H. Hurst and F. Mallet. I acknowledge to have received the full consideration money where in mentioned to be paid to me. Mark of Francois Bisalion. Witnesses H. Hurst F, Mallet. Be it remembered that on the day of the date within Indenture before me the subscriber one of the Justices of the Peace personally came Francois Bisalion who acknowledged the Indenture to be his act and deed and desired the same be recorded as such. Stout. Another notation: Recorded in my office Vincennes Knox County this the ninth day of May 1809. Book E. pages 424 and 425. J.D. Hay, Recorder 128. The second document the promissory note, I promise bind and oblige myself to pay or cause to be paid unto Jacques and Francois Lasselle on or before the ninth day of June 1810 the sum of seven hundred and thirty dollars and seventy-five cents with interest from the date here of. Ninth day of May 1809. the mark of Francois Bisalion and witnesses H. Hurst and Fr Mallet. The third document was a Summon to the sheriff to give notice to Ettiene Bizayon, the administrator of Francois Bizayon, to appear before the judges in Circuit Court on the first Monday of March. The property was described as a certain house and lots of grounds where Francois Bisalion lived situated in the Village of Vincennes which were purchased from Toussaint Dubois and bounded by three streets and the River Wabash. The summon stated Ettiene Bisalion was to show cause why the mortgaged premises should not be seized and taken in execution of payment. The summons was witnessed and signed by Robert Buntin, Clerk CCKC on the fifth day of December 1815. On the verso, To foreclose mortgage for sum of $730.75. Executed by reading the within to the Defendant in presence of H Lassell and Fred Watson, B.V. Beckes Sheriff Knox County . Service $0.37 1/2, Return $0.09. total $0.46 1/2. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817, page 250: March Term 1816, the Plaintiffs appeared by G.W. Johnston, their attorney. The Sheriff returns that by virtue of the writ of Sci. Fa. that in the presence of H. Lassell and Frederick Watson, he was given notice to the Defendant to be present before the judges at the present March Term. The Defendant made default. I was considered that the mortgage be foreclosed and the property sold to satisfy the debt, interest, and expenses of the Plaintiffs.
