An indenture was made on August 7, 1810 between Robert Adams and the Knox County Indiana Territory on the one part and David Snyder of Knox Territory on the other part in the sum of $1300. The amount was to be paid to David Snyder before or on delivery on a certain tract of land situated on the map of donation lands marked as #53 containing 400 acres. The said tract of land was purchased by Robert Adams of said David Snyder and wife by said David Snyder of Isaac Westfall together with all singular the rights, money and appropriations. The agreement was that $300 was to be paid on or before the first day of May 1811, $300 on or before the day of May 1812, $300 on or before May 1813 and lastly $300 on or before May of 1814. It was stated that failing to pay shall void agreement. The document was signed on August 10, 1810 by Robert Adams, before Will Jones and witnessed by H. Hurst, John McClure and G. R. C. Sullivan. The land record sale was recorded in Vincennes, Knox County on November 21, 1810 by J. D. Hay, Recorder in Book F. p. 81 and p. 82. The land record was also recorded in Book A. on November 1, 1815 on pages 259 and 260 by. J. D. Hay, Recorder. A summons is sent to the Sheriff of Knox County to foreclose on the mortgage of Robert Adams for a debt owed of $1300 to David Snyder. The mortgage was for a tract of land containing 400 acres known on the map as a plot of donation #53. These lands were granted by the United States to heads of families at Vincennes on or before 1783. A secured payment of $1300 was to be paid but some time has elapsed since the debt was to have been paid and David Snyder brings suit before the judges of the Circuit Court. Robert Adams is to come personally before the judges on the first Monday of June next to show why property should not be sized and taken in execution for payment, interests and costs. The document was witnessed by Robert Buntin, Clerk on May 17, 1815. B. V. Beckes, Sheriff states that Robert Adams, defendant, can not be found within his bailiwick. A copy of the summons dated June 16, 1815 was filed. The summons was on foreclosure on the mortgage of Robert Adams. The summons was filed June 16, 1815. B. V. Beckes, Sheriff again states that Robert Adams was not found in his bailiwick. During the October term a cost of court bill was filed. The dates on the cost of court are from May 17, 1815 to October 1815 in the amount of $13.61. The mortgage of Robert Adams was foreclosed on with property being seized. The property is to be sold to pay the debt and interest owed. |
