Pea, Henry vs. Thomas Coulter and Joseph Decker, Jr. 1808

Description: The file contains the documents that are related to the suit Henry Pea brought against Thomas Coulter and Joseph Decker, Jr. for failure to pay off a Promissory Note for $35.00 written in 1807. The Promissory Note dated December 3, 1807 was written to Henry Pea for $35.00 for value received. It was to be paid off in too (two) months from the date signed. Joseph Decker, Jr and Thomas Coulter signed the note. It was witnessed by Rachel Peas mark and Thomas Chaimbers mark. On February 4, 1808 a complaint was filed by Henry Peas attorney [Gen. W. ] Johnston. The complaint made a plea of debt owed to Henry Pea from a Promissory Note signed by Decker and Coulter. It was to be paid in two months and had not been paid by February 4, 1808. The complaint asked for damages of $100.00 and pledged to prosecute. Henry Peas assigned Gen. W. Johnston as his attorney in this suit. A Summons was issued to pick up Decker and Coulter to ensure they would appear in court on the last Monday of July 1808. The Summons was written by R[Robert] Buntin, Clerk, CPKC. On the back of the Summons, it stated that bail was required and executed by Samuel Hayes, D. Sheriff. Appearance bail was posted by Miles Dollohan [Dolohan]. Fees of $2.31 were attached and a tax of $.50 was paid. Appearance Bond of $70.00 was posted by Thomas Coulter, Joseph Decker, and Miles Dolohan. Samuel Hayes Executed the bond. According to the Minute Book of the Knox County Court of Common Pleas, p. 157; during the November Term 1808, the Plaintiff appeared by his attorney, Johnston. The Defendants were called but did not appear. It was ordered that the Plaintiff recover of the Defendants and Miles Dolohan $35 with interest from the 3rd of February 1808 until the debt is paid. Expenses related to the suit will be paid by the Defendants. Court costs were $12.91 1/2.
