Bullitt, William and Charles Smith vs. Daniel Decker 1808

Description: The file contains the documents regarding the suit William Bullitt and Charles Smith brought against Daniel Decker for failure to pay a debt from 1804. On October 20 1804, Daniel Decker wrote a Promissory Note to William Bullitt and Company for $39.87 1/2 for value received. On the back of the note: Credit $15.00 1805, 4 July 1 Sickle / 6 Tobacco .0087 1/2 total $14.12 1/2. During the July Term 1808, John Rice Jones filed a Declaration to attach Daniel Decker to answer to William Bullitt and Charles Smith for a debt of $39.87 1/2 . A Summons was issued for Daniel Decker to appear in court on the last Monday of July to answer to William Bullitt and Charles Smith on a pleas for refusal to pay a debt. The Summons was written by R [Robert] Buntin, Clerk CPKC. Bail was required for the amount of the debt. The Summons was executed by Samuel Hayes, Deputy Sheriff. The tax was paid by the Plaintiff. On July 25, 1808, bond was posted by Daniel Decker and co-bond of Andrew Purcell. They posted $100.00 to ensure Daniel Decker would appear in court the last Monday of July to answer to Bullitt and Smiths plea that he render the sum of $39.87 1/2 and damages of $100.00. The document was signed by Daniel Decker and Andrew Purcell and executed by Samuel Hayes. According to the Minute Book of the Knox County Court of Common Pleas, pgs 122, 124; The Plaintiff appeared by John Rice Jones and the Defendant in his person and confessed judgement for $39.87 1/2 to be discharged by payment of $32.49. The order stated that the Plaintiff do recover $32.49 and charges and costs. The Court costs totaled $10.99 1/2.
