A summons is issued to take William H. Dunnica to court the last Monday of July next to answer unto Peter Jones, assignee of Jones and Dubois on a plea of debt owed in the amount of $82.50 plus damages of $150. The summons is witnessed by R. Buntin, Clerk on June 15, 1811. Bail is required and the summons is executed by B. Beckes. William Stewart paid bail. A recognizance bond for Homer Johnson and William H. Dunica is filed. They are held and firmly bound unto Peter Jones assignee of Jones and Dubois in the full sum of $82.60 on June 5, 1811. Homer Johnson now in custody is to stay within the prison bounds as laid out. The bond is executed before William Prince Justice of the Peace and Eli Stout, June 1811. H. Johnson is now in custody and is to be held within the prison boundaries. This was acknowledged before William Prince, Justice of the Peace and E. Stout, Justice of the Peace and signed by Homer Johnson and William Dunica. H. Hurst replies by his attorney H. Hurst and he says he has fully complied with the conditions. The plea was objected to by the plaintiff on the grounds that payment should have been payment of debt and and his bill signed paid and made a part of the record. Signed James Johnson and Daniel McClure. William Dunica and William Stuart are firmly bound unto John McCandless in the sum of $82.42 on June 15,1811. The conditions of the bond are that William Dunica appear before the judge the last Monday of July next and answer unto Peter Jones, assignee of Jones and Dubois in a plea of debt. The bond was witnessed by P. Beckes and signed William H. Dunica and William Stuart. On July Term 1811, Peter Jones assignee of William Jones and Toussaint Dubois (in custody) on a plea that William Dunica render unto him the sum of $82.40 which he unjustly detains from him and refuses to pay. He asks for debt due and damages of $150. Signed Johnston P. Q. At the March Term 1812 Court, Peter Jones ordered a copias ad respondeum against William Dunnica to bring him to court the last Monday of July next to answer unto him on a plea of debt and damages. The document was sent June 5, 1811. The court decides for the defendant and the plaintiff asks for exception during the March Term 1812. The document is signed by James Johnson, Luke Decker and Daniel McClure. William Dunica defendant, entered a special bail in the case then moved the court for a rule against the plaintiff. The plaintiff countered before the court and entered a special bail. The court decided the defendant was entitled to oyer (the hearing of a document in court) which plaintiff agreed to. This bill of exceptions was signed and sealed according to wherefore during the March Term 1812. On a motion of the plaintiff by his attorney the judgement default was taken herein the Clerks office and was confirmed that he do recover of the defendant and William Stewart his appearance bail the sum of $82.60 the debt in declaration mentioned together with interest from June 5, 1811 and his costs and charges by him in suit. Robert Buntin certifies that the above is correct and is a true copy of the records of the proceedings had in the above case and record found in his office May 4, 1812. On reverse the writ of error to be input in the case with the defendants bond used as security in double amount of the judgement. The document is signed B. Parke. |
