This file contains the documents related to the suit Francoise Depuis (Dupuis) brought against Ettienne Bizayon, administrator of Francois Bizayon (Bizayon/Bizyom). The complaint states that Ettienne Bizayon was summoned to answer unto Francoise Depuis for a debt of $1130.50 on October 14, 1810 and was signed by General Washington Johnston. There is a note on the verso signed by foreman William H. Dunnica that the jury found for the plaintiff. In the rebuttal, the defendant states that Francois Bizayon did not promise to pay the plaintiff. The rebuttal is signed by John Johnson and General Washington Johnston. The original account, dated March 27, 1797, was written in French and signed by Berte Grima. The security bond, dated February 17, 1812, indicated that the defendant agreed to enter himself as security and was signed by William Price, General Washington Johnston, and Robert Buntin. In the affidavit, Rene Deveau (Denneau) swore that the items listed in the account were the property of the plaintiff and that it was the general custom among the French to charge $1.00 per week on unpaid debt. Thus after 684 weeks the defendant owed an additional $684 plus the original cost of the items. Some of the items from the account included a drawing knife, linen, Castile soap, a buffalo rug, a brown horse, muslin, cotton, coffee, an axe, tobacco, thread, ribbons, and other items. The subpoena, dated March 14, 1812, called for Rene Deveau, Antoine Petit, and the wife of Bennoist Bizayon to give evidence on behalf of the plaintiff. The subpoena was signed and witnessed by court clerk Robert Buntin and executed by deputy sheriff John I. Neely at a cost of $84 cents. The court cost bill totaled $18.08 1/2 cents. |
