Description: The file contains numerous documents related to the case Francois Bizayon filed against Samuel Carruthers for Replevin in the Knox County Court of Common Pleas. February 12, 1802, Francios Bisayon offer security that he would prosecute his claim against Samuel Carruthers. He asked for a writ of Replevin against Samuel Carruthers who took one large brass kettle and one iron Dutch . The writ was witnessed by James Johnson, witnessed by R[Robert] Buntin Prothonotary, and executed by Wm. Prince. On the back of the writ, I have the property. Wm Prince. April 9, 1802, Francois Bisayon and John Rice Jones put up bond of $30.00 to William Prince, Sheriff. The document was witnessed by Albert Prince, signed by John Rice Jones and the mark of Francois Bisayon. In a complaint filed by John Rice Jones, attorney for the Plaintiff, during the May Term 1802; it stated that Samuel Carruthers was summoned to answer to a plea that Carruthers took goods and chattel of Bizayon. Carruthers took the goods and unjustly detained them from a house on Front Street next to the Wabash River. He asked for $20.00 in damages. October Rules 1802; in a response written by Robert Hamilton, attorney for the Defendant; it stated that the goods and chattel were taken in two rooms in a cellar and dwelling on Main Street owed by Mad. Angelique Conoyer. Francois Bizoyon had not paid the rent. In response, to the Defendant, the Plaintiff stated that the rent was not in arrears. On August 5, 1803, a Subpoena was issued for Toussaint Dubois to appear on the First Tuesday in November 1803 to give evidence on behalf of Samuel Carruthers in an suit of Replevin. The Subpoena was witnessed by James Johnson, issued by R [Robert] Buntin, Prothonotary, and executed by William Prince. On November 12, 1803, a Subpoena was issued for Toussaint Dubois to appear on the First Tuesday in February 1804 to give evidence on behalf of Francois Bizayan. The Subpoena was issued by R [Robert] Buntin, Prothonotary and executed by Wm. Prince. Toussaint Dubois was again subpoenaed to appear to give evidence on the First Tuesday of May 1804 on behalf of Samuel Carruthers. R[Robert] Buntin, Prothonotary, issued the Subpoena and it was executed by Wm. Prince with a fee of 34. Toussaint Dubois was again summonsed to appear in the February Term 1804 to give evidence for Samuel Carruthers. The Subpoena was written by R. Buntin, Prothonotary, executed by Daniel Sullivan, Sheriff with $.34 fees added. On May 8, 1805, R Buntin, Prothonotary Subpoenaed Toussaint Dubois and Jonathan Purcell to appear in the August Term 1805 on behalf of Carruthers. The Subpoena was witnessed by Able Westfall, executed by Abrm Defrance, Deputy of D. Sullivan, Sheriff; $1.20 fees were added. April Term 1807 in General Court; the parties came by their attorneys and a writ of Error was filed to go back to the Court of Common Pleas for a rehearing. Henry Hurst, CGC documented this writ. March 11, 1808 Jean Bte. Duquender dit Fontinary and Jayal were Subpoenaed to appear in the Court of Common Pleas by R. Buntin, Clerk. On March 22, 1809; Jonathan Purcell was requested by ___Coulter in the absence of Thomas Coulter to inspect and value tallow which F. Bizayon sold to Coulter in payment of house rent. The tallow was valued at three pounds. General Jonathan Gibson was the other evaluator. According to the Minute Book of the Knox County Court of Common Pleas 1807-1810; the case was continued from March Term 1808 through the March Term 1809. A jury consisting of : John Harbin, William Hoge, Enoch Davis, Isaac McCoy, George McCormick, Abraham Westfall, Jr; Henry McGee, James McClure, George Tevebaugh, Samuel Lemmon, Samuel Hayes, and George Rath found for the Defendant. The six dollars rent was due on Bizions leaving the house unpaid.
