Court transcript written by Robert Buntin,Clerk, of the suit Richard Price brought against Samuel Coleman for not paying for thirteen hats. Richard Price sued for a writ to have Samuel Coleman brought to court to answer to charges that he did not pay for the hats he purchased. The writ was witnessed by Robert Buntin, Clerk. It was executed by John Decker, SKC, on October 18, 1821. Robert Buntin acknowledged himself Special Bail for James Coleman. September Term 1821, the Plaintiff, represented by Moses Tabbs, filed a Declaration that Samuel Coleman, in custody, on May 1, 1821 was in debt for thirteen hats, at a cost of one hundred and two dollars. Although he had promised to pay the debt, he had not paid any part of the debt. He asked for two hundred dollars in damages. The case was continued two times until the June Term. June Term 1822, the Plaintiff represented by Moses Tabbs appeared, the Defendant, represented by Judah and Sullivan, filed a motion that the affidavit filed by the Plaintiff was not sufficient to demand a Special Bail. It was ordered that the Defendant be discharged from Special Bail and Bail was released. An attachment was issued against William Walker for not attending as a witness. The attachment was directed to the Vigo County Sheriff. March Term 1823, jury trial with the following jurors: William Hart, John Widner, Jacob Harper, David Collins, Fredrick Watson, Jonathan Hornback, John Young, John Welton, William Curry, Robert McClure, Francis Davis and Objah Hull. Francis Davis, foreman reported that the jury found for the Plaintiff, sixty-four dollars in damages with interest. A motion was made by the Defense that the Plaintiff pay the jury fees. G. R. Sullivan acknowledged himself security in the case. |
