The file contains the documents related to the suit Thomas Palmer brought against Philip Stum for the failure to pay a Promissory Note. On October 15, 1808, by his mark Philip Stum signed a Promissory Note to Thomas Palmer. He promised to pay to Palmer a horse worth eight dollars in trade or fifty dollars in money for value received by the first day of September next. It was witnessed by John Mc Donald. In an Affidavit, sworn before Daniel McClure, one of the Judges of the Court of Common Pleas, Thomas Palmer swore that Philip Stum was indebted to him in the sum of eighty dollars in trade or fifty in money and Stum did not reside with in the territory. R [Robert] Buntin, Clerk, CPKC, issued an attachment order on July 29, 1811. The sheriff was to attach all singular goods and chattels rights and credit, lands tenements of Philip Stum and have them ready before the Judges of Knox County Court of Common Pleas to answer unto Thomas Palmer in a plea of trespass for the sum of eighty dollars and that he summons person who may have the goods, on the third day of the present term as garnishees to answer to Thomas Palmer. On the verso side of the Summons by virtue of the within attachment, I have attached two hundred acres of land part of two tracts, numbers 39 and 42 laying on the south side of White River in Knox County. B [Benjamin] Beckes. A fourth document written on July 29, 1811 stated there was a foreign attachment returnable today. In a Complaint filed by John Johnson, attorney, filed for Thomas Palmer, Court of Common Pleas; Philip Stum or Stam was attached by his goods and chattel to answer unto Thomas Palmer in a pleas that on the fifteenth day of October 1808 in Knox County, signed by his mark a Promissory Note. He promised to pay Thomas Palmer on the first day of September next a horse worth eighty dollars or fifty dollars for value received. He had not repaid the note although it had been requested. On the verso side of the Complaint;we of the jury find for the Plaintiff fifty-eight dollars and seventy -five cents in damages, Wilson Lago, foreman. On July 30, 1812, Thomas Palmer and John Johnson posted Security Bond in the sum of one hundred and seventeen dollars and seventy dollars and fifty cents. This document stated, where as this day Thomas Palmer hath recovered judgment in the Court of Common Pleas fifty-eight dollars and seventy-five cents on foreign attachment. The condition of the above obligation is such that Thomas Palmer will appear to any suit that shall or may be brought by Philip Stum within twelve months from the date here of or said Judgment and shall pay unto Stum all such sums of money which on trial to be had thereon the mark of Thos. Palmer. Acknowledged in Open Court. R. Buntin. According to the Minute Book of the Knox County Court of Common Pleas 1811 -1817, pages 54 and 60; during the July Term 1812, the Plaintiff appeared by John Johnson. The Defendant did not appear. On a motion a jury was called. The jury consisted of: Willson Lago, Thomas Martin, Jonathan Marney, Thomas Anderson, William Rutherford, Hugh Kelly, William Stewart, John Gamlin, James Stewart, William Baildy, John Bruner, Francois Mallett. The jury found for the Plaintiff the sum of fifty-eight dollars and seventy-five cents in damages. On a motion it was considered that the Plaintiff recover of the Defendant the sum stated above, and the cost and charges related to the suit. Thomas Palmer filed his bond with William Bruce as by law directed. |
