Joseph Bouche and James Stafford vs Edwin Jones and William Heberd 1848

Description: The file contains the suit Bouche and Stafford brought against Edwin M. Jones and William Heberd. A judgement had been awarded to the plaintiffs of $83.65 and against Jones on July 22, 1846 by Justice of the Peace John Collins. When the judgement was executed, no property was found. The plaintiffs stated, that Jones did have real estate property and Heberd sold the property to him. The suit is to receive payment of the judgement. Included is the petition, copies of the court transcripts of the judgments, promissory notes, summons to court and a petition by Morgan Jones to be added to the law suit. In the petition written by B. M. Thomas, attorney for the plaintiffs, it is stated that Edwin M. Jones became indebted to the plaintiffs by a judgement of $83.65, interest, and costs. Awarded by Justice of the Peace, John Collins. When it was executed on August 5, 1846, no property was found. There was another judgement, September 29 1841 against the property of Edwin M. Jones and Jeremiah Donavan for $176.67 with $11.25 being paid. Replevin bail was posted and the complaint stated Jones and Donavan were insolvent. Additionally, during the March Term 1839, a judgement was made against Edwin Jones and in favor of Nathan Ballon and 70 acres of land were sold as well as another tract of land of 198 acres. These two tracts of land were purchased by William I. Heberd. The land was then sold to Edwin M. Jones by Heberd. The petition asks that Heberd be a defendant and called to explain the real estate agreement, and the land be sold to pay the judgement. A Demurrer was filed by C. M. Allen, attorney for the defendants, saying that they did not have enough evidence to proceed with the case. Included in the file was the court transcript of the Joseph Bonner associate of George Wilkers vs Edwin M. Jones suit. A judgment against Jones for $83.65 and when executed on August 5, 1846, no property found. Signed John Collins. In a promissory note by Edwin Jones and James Colins to John Law, David Bonner, and Nicholas Smith they promise to pay $36.33 1/3 in 12 months. On the back of the note, R. S. Smith signed over his interest to Bonner and Law. A second court transcript signed by Samuel Hill, Justice of the Peace, documented the suit David S. Bonner and John Law brought against Edwin Jones for a debt of $36.45. Summons were issued to appear in court, Collins was not found and Jones did not appear in court on June 27, 1840. On July 17, 1840; Edwin Jones signed a bond document to David Bonner and John Tracy for $70.00. It was co-signed by Isaac Mass. Judah and Ellis, attorneys for Morgan Jones, petitioned to be added to the Bouche and Stafford suit because, Edwin Jones was in debt to him for $270.27. A note on the petition stated it would be allowed. A summons was issued for James Collins and Edwin Jones to appear before Judge Samuel Hill on June 1840 for a debt of $36.45. It was executed by A. Coneger but Collins was not found. During the February Term 1848 a summons was issued for Edwin M. Jones to appear in court and executed by Isaac Mass. Another summons was issued for Edwin Jones and William Heberd to appear at February Term 1848 to answer to a Bill of Complain by Alvin Tracy, David Bonner, Harry McFarland, Joseph Somes and W.R. McCord.
