Description: The file contains the documents related to the suit William McIntosh, assignee of Andrew Scott, brought against William Lindsey for failure to repay a Promissory Note for fifty dollars. On September 25, 1809, William Lindsey signed a Promissory Note to Andrew Scott for fifty dollars for value received. He was to repay within eight months. The note was witnessed by Saml. Parr. January 7, 1811 a Summons was issued for William Lindsey to be taken into custody so that he would appear before the Judges of the Knox County Court of Common Pleas on January 8, 1811. He was to answer unto William McIntosh, assignee of Andrew Scott, in a plea of debt of fifty dollars and damages of twenty dollars. The Summons was issued by Robert Buntin, Clerk CPKC and executed by John McCandless, Sheriff. Court cost to serve the Summons was $.59. During the January 1811 Term of the Court of Common Pleas, Hurst, P.Q. (attorney for the Plaintiff) filed a Complaint that William McIntosh, assignee for Andrew Scott, complained that William Lindsay render to him the sum of fifty dollars which he owed and had unjustly detained. On August 12, 1811, a Subpoena was issued by Robert Buntin, Clerk, for James and George Lindsey to appear for William Lindsey at the suit of William McIntosh. In a response to the suit, Gen. Johnston, attorney for the Plaintiff, stated that Lindsey defended the wrong and injury and the suit should not have been brought and that he had fully paid the debt and was ready to verify. The last document was an account sheet, William McIntosh to Wm. Lindsey: March 1811 to 2750 bricks by Anbern (?) Corrie at $6 per thousand $16.50; April 2 to halling (hauling) 6 cart lode to the river $1.50; to 750 bricks by Josep Delane $4.50; April 21 to 1 500 bricks by Westfall $9.00; to 1 500 bricks by Westfall $9.00; to halling 4 cart lode to the river $1.00 Total $41.50. W. Lindsay assures me that he furnished the brick and hauling them out. I am inclined to believe him and admit it on amt. of his note. To Hurst. Wm. McIntosh. According to the Minute Book of the Knox County Court of Common Pleas 1811-1817 pages 21 and 31; The suit was continued from the November Term into the July Term. The parties appeared by their attorneys, the Defendant confessed judgement for the sum of $12.09 1/2. The Plaintiff was to collect $12.09 1/2 and court costs.
