The file contains the documents related to the suit Isaac Miner brought against Jeremiah Claypoole for failure to pay debts. It was filed in the Knox County Court of Common Pleas in 1808. Included in the file are numerous accounts of debits and credits that cover both Miner and Claypoole. During the March Term 1808, Gen. W. Johnston filed a complaint for Miner against Claypoole. It stated that on April 5, 1805, Claypoole owed $75.93 1/4 to Miner for goods received. The Complaint stated they would prosecute and put Gen. W. Johnston in as the attorney for Miner in this case. A Summons was issued for Jeremiah Claypoole to appear in court on the last Monday of March 1808 to answer to a plea of trespass and damages of $200.00. It was issued by R [Robert] Buntin, Clerk on December 21, 1807. On the verso, tax paid, executed by Saml. Hayes, Dep. with $185 court costs added. According to a court transcript by R[Robert] Buntin, Clerk CPKC, during the July Term 1808, the parties were call and agreed to go to arbitration with Peter Jones, Thomas Jourdan [Jordan] and John D. Hay acting as arbiters. Documents related to the accounts of Miner and Claypoole included the following: Received of Jeremiah Claypole one hundred acres of land at one hundred twenty-five dollars and eleven pound, nine shilling. Out of the store one sadle [saddle] he got W. Johnston per twenty dollars and one saddle from Jon Pursel [Purcell] at eighteen dollars and seventy five dollars he paid to Mr. Harbin for me. A second document with this information was included with a total of $276.16 1/2 being the total. Signed Isaac Miner. On the verso of the document, settle with Isaac Miner 4.14 dollars for 72 barels [barrels] of flour. An account February 1800: account of Claypoole with I . Miner: 300 pounds fleas [fresh] bore [boar] meet [meat] at $6/100$180; 14 venison hams $7.00; too [two] wild geese and too [two] turkeys $2.00. September 1799: one cow and calf $20.00. 1801: Twenty too [two] barrels of flour $4.14 One horse $75.00 Another account 1802: Account Isaac Miner with Claypoole: Notes to Mills $45.50; Goods from Bullitts [store] $20.00; 2 deer skins $2.50; Paid Jacob Decker $4.25 Do $72.25 1802, September 23 Pay note to you $138; D brought over $72.25 Balance $65.75 1805, April 5 by interest May; Note from 23 September 1802 to 23 March --interest 2 yr. 7 months = $75.93 3/4 signed by Jerh. Claypoole, Jon Purcell Gen. Johnston, Water Wilson, and Jacob Miner. A document from Collectors Office Vincennes, April 19, 1802, E. Tisdale, Collect Revenue 3 D 2 NWD, an affidavit: Mr. Robert Asturges applied for a stamp of Tenants and paid ten cents. On April 20, 1802, a bond was posted to promise to pay Robert Asturges $71.25. The signature was cut out. It was witnessed by Luke Decker. February 8, 1803 to Jeremiah Claypool, please let Jacob Decker have credit for $5.25 on my account, signed Isaac Miner. Miners as Purcell and Claypoole for assumpsit McComb camo on credit Book 1 1916. The arbitrators report of September 18, 1808 stated that Jeremiah Claypoole pay the sum of $8.55 3/4 unto Isaac Miner together with his costs and charges related to the suit. The total for the judgment was $34.51 and 3/4. |
