Defrance, Abraham vs. Peter Ruby, et. al. 1808

Description:	The file contains the documents related to the suit Abraham Defrance brought against Peter Ruby, Mark Dunning and John Hatten for failure to pay off a promissory note in 1808. On October 1, 1806 Peter Ruby, Mark Dunning and John Hatton signed a Promissory note to Abraham Defrance for $33.75. The note was to be paid off in two years and was witnessed by John Eldr (?) Hughes. During the November Term 1808, a compliant was filed by Johnston P.Q. the attorney for Abraham Defrance against Ruby, Dunning, and Hatton. The complaint was on an action of debt for $32.75 and asked for damages of $100.00. Gen. W. Johnston was put in as the attorney for Defrance in this suit. A Summons was issued for Peter Ruby, Mark Dunning and John Hattin to appear in court the last Monday of November 1808. R [Robert] Buntin, Clerk CPKC issued the Summons. On the verso, bail required for debt; William Lindsey posted bail. The Summons was executed by P [Parmentas] Beckes, Sheriff with $2.99 fees attached. On October 22, 1808, John Small entered himself as security for costs in the suit. Peter Ruby, Mark Dunning, John Hatten and William Lindsey posted appearance bail on November 26, 1808 before John McCandless. According to the Minute Book of the Knox County Court of Common Pleas p. 184, during the March Term 1809, the Defendant, Peter Ruby appeared by his attorney and confessed Judgment. The Defendants were ordered to pay the Plaintiff $33.75, interest from October 1, 1808, and costs and charges related to the case.
