Jones, Thomas vs John Duhamel [Duhammel Duharmel]

Description:	This file contains the documents related to the suit, Thomas Jones, merchant, brought against John Duhamel on a plea of trespass in the Knox County Court of Common Pleas in 1806. According to the complaint written by John Rice Jones, the attorney for the Plaintiff, William Ferguson, a servant of John Duhamel, entrusted by John Duhamel, made a promissory note May 10, 1806, with John Duhamels name, to Thomas Jones for $141.12 1/2. The note had not been paid and he was asking $100 in damages. An attachment was issued for the person of John Duhamel and the property and goods of John Duhamel to assure his appearance in the Knox County Court of Common Pleas in November 1806. He was to answer to Thomas Jones plea of trespass and damages of $100. The summons was written by Robert Buntin, Clerk. It was executed by Abraham Defrance, Deputy Sheriff with cost fees of $1.21. On the back of the summons, Robert Buntin wrote an affidavit filed for the sum of sixty four dollars. A bond document for $64. was signed by Antoine Marchal, [Toussaint] Dubois, and Wm [William] Ferguson for John Duhamel. John Duhamel, denied the charges through his lawyer, General W. Johnston and put himself at the mercy of the court. The Plaintiff, through his lawyer, John Rice Jones, asked for an inquiry by the Court. In an affidavit, sworn by Thomas Jones, before Henry VanderBurgh, he stated that John Duhamel was indebted to him for $64.65 1/2 on the balance due the note. He also stated, he did not believe Duhamel was a resident of the Indiana Territory. According to the Knox County Minute Book of the Court of Common Pleas, page 10, the case was dismissed with the Defendant paying the court costs.
