Daniel F. Steinbeck vs Thomas Jones

Description: Court transcript and a copy by Robert Buntin, Prothonotary of the suit brought against Thomas Jones for Breach of Covenant with damages of one hundred and fifty dollars. Steinbeck sued for a writ of Capias respondenum against Thomas Jones to appear in the August Term to answer to a plea of covenant broken. The writ was witnessed by Pierre Gamelin on May 13, 1800 and executed by John Ockiltree. August Term 1800, Daniel Steinbeck appeared by his attorney Henry Hurst, Thomas Jones by Robert Hamilton. The cause was continued. November Term 1800, Daniel Steinbeck by his attorney file a Declaration that complains of Thomas Jones in Custody, in a plea of beach of covenant. An agreement was made on September 6, 1798 at Baltimore. Steinbeck engaged himself in the business of Jones for twelve months for which Jones is to pay him one hundred dollars and find him in good boarding, washing and lodging. Jones was to pay all his expenses from here to Post Vincennes and back next year to Baltimore. The Defendant was called three times and did not appear. An order was made for a Judgement be entered for the Plaintiff for the sum of one hundred dollars, the Plaintiff gave up on the expenses to Baltimore. February Term 1801, the Defendant filed his response that the Declaration does not show a covenant in as much as an agreement and, cause should cease and abate. The Plaintiff by his attorney produced a writ of Habeas Corpus cum causa and the case was removed into the General Court of the Territory.
