Solomon Hays vs Fredrick Greater

Description: Court transcript of the suit of Solomon Hays vs Fredrick Graeter was written by Robert Buntin. In February 1801, a Writ of capias ad respondenum against Fredrick Graeter was filed by Solomon Hays. The Writ was for Graeter to answer Hays plea of Trespass on a case of slander and was asking ten thousand dollars in damages. The Writ was witnessed by James Johnson and executed by Wm Prince, Sheriff. May Term 1801, Solomon Hays appeared and was represented by his attorney, General Washington Johnston. Fredrick Graeter appeared and was represented by his attorney, Henry Hurst. Hurst, asked leave to imparl. The case is continued to the next court term. August Term 1801, Fredrick Graeter in custody. Hays with his attorney made his Declaration.. that he is a true, pious and honest subject of the United States and as a good true, pious and honest subject of the United States hath hitherto demeaned and behaved himself as a good true pious and honest subject never guilty of theft, but because, Fredrick Grater uttered in public, have you heard that the little Jew, Mr. Solomon Hays stole a quantity of of money at Michinmaccinac from a man called Bouthelia, also a silver watch which he sold in this country and which was marked. He is injured. Fredrick Greater, by Henry Hunt askes to imparl until next term. November Term 1801, the Defendant produced a writ of Certiorai and the cause was removed to the General Court.
