Sally Frederick vs George Frederick, John Frederick and Peter Fox

Description: Sally Frederick, widow of Henry Frederick per her attorney C. M. Allen is suing for her dower rights. She states that at the time of Henrys death he owned real estate viz 150 acres part of Donation #192 and one hundred acres bounded by Donation #181 and on the other side by Donation 191 snd on another side by part of Donation #192 and on another by land owned by Jacob Frederick. She states she has not received her dower rights and that John and George Frederick are heirs under the age of 21 and at Henrys death Jacob Frederick was the administrator of his estate. It also states that Jacob Frederick as administrator has sold 50 acres of the S. E. corner of property to Peter Fox. C. M. Allen, attorney for the plaintiff asks the sale be issued. The document is filed November 23, 1849. W. R. McCord, Clerk sends orders to the Sheriff to issue subpoena for George and John Frederick and to Peter Fox. They are to appear in Court of Chancery on a bill of complaint on the 2nd Monday of December 1849. The Sheriff noted that the execution of the summons was by reading on November 25, 1849 with a cost of $2.07. A decree was issued by W. R. McCord who is appointed guardian of George and John Frederick. George Calhound, William Penny and James M. Emison are appointed Commissioners who divide up the land of Henry Frederick. On September 17, 1850 the take the oath as Commissioners before George Calhound, Sheriff of Knox County. W. R. McCord was appointed guardian of George and John Frederick. He states that they know nothing of the suit. The document is filed June 22, 1850. A report of the Commissioners is filed September 17, 1850. The Commissioners have set off the dower of Sally Frederick. She is given part of 150 acres being 44.020 of an acre shown in the diagram within the report. The document is filed September 17, 1850 by George Calhound and James M. Emison with cost fees.
