A summons is issued for George Colegrove, Pleasant Fitzgerald, Thomas Fitzgerald, Benjamin Shaw, Alfred Ervin, John Bicknell and John Mills to come to court on June 7, 1849 to testify on behalf of William Davenport. On June 1849 W. R. Mc Cord, Clerk makes a statement that witnesses are claimed and sworn. An affidavit is filed before W. B. Willis, J. P. stating that Thomas and Pleasant Fitzpatrick and Joseph Ashby are sworn to answer questions about the account of John Fitzpatrick. Thomas Fitzpatrick answers the questions. He states he does not know what is owed as to the sewing of shoes. He does know about the hauling of potatoes, murrain of hides, pattern of shoe leather, about the chickens, log chains and that he heard his father ask to barrow 5 bushel of corn, but he is uncertain to how much was received. He states he knows of beef that he received of Davenport. He also knows he borrowed a horse and that his father also asked Davenport to house his hands. Pleasant Fitzpatrick states he knows of ten days pulling corn, and 3 days making rails, plowing, cradling, and mowing but not of how much of laying off corn ground. John Ashby states he knows John Fitzpatrick was to give 150 bushels of corn to Davenport. The account is filed March 10, 1849 by W. B Willis, J.P. cost unpaid $2.67. The account balance is $150.02 1/2. |
