A promissory note signed by James Stewart is presented. He had promised to pay John Myers the just and full sum of $91. The debt was due two months after the date received of August 17, 1815. A note signed by John Myers and James Stewart that the promissory note was assigned over to James G. Reed for $91 on August 30, 1815 is presented. A summons is issued to the Sheriff of Knox County to bring James Stewart before the judges of the Circuit Court held at Vincennes the first Monday of March next. He is to answer to James G. Reed assignee of John Myers on a plea that he render to him the sum of $91 which he unjustly detains from him to the damage of the said James G. Reed the sum of $100. The summons was dated October 20, 1815 and witnessed by R. Buntin, Clerk of Circuit Court. During the March 1816 term a suit was brought on a note under seal therefore bail is requested for $91 per G. W. Johnston, P. Q. The writ was executed by P. Almy, Deputy Sheriff with a service and return listed as $1.34. A recognizance bond was filed during the March 1816 term. Upon March 4, 1816 James Andre personally came before Philip Almy, Deputy Sheriff and undertook for James Stewart at the suit of James G. Reed assignee of John Myers on a plea that he render to him the sum of $91 now pending in the Circuit Court. The court is to be held at Vincennes the first Monday in March next. He is ordered to appear and pay and satisfy the condemnation of the said court or render his body in execution to prison or he will do it for him. In witness where of we have here unto set our hands and seals. Signed James Stewart and James Andre with Philip Almy signing as witness. A complaint is filed by James G. Reed assignee of John Myers. He has filed against James Stewart and asks that he render to him the sum of $91 that he unjustly detains from the said defendant. He states he received the funds on August 17, 1815 and promised to repay the debt two months after the date. He also states that the note has been assigned to the said James Reed by John Myers. The note was due October 18, 1815 yet he has refused to pay so he asks for $100 in damages. A cost of court bill was filed from October 20, 1815 to June 1816 in the amount of $10.87. A note on back states the fee is satisfied. The plaintiff appeared in court by his attorney and the defendant did not appear and made default. Therefore it is considered by the court that the plaintiff do recover of the defendant the sum of $91 and $3.60 interest together with cost and charges. |
